Title
Authorizing the execution of an Underground Electric Line Easement to Madison Gas and Electric Company across a portion of the Cypress Spray Park, located at 902 Magnolia Lane.
Body
WHEREAS, the City Parks Division constructed a public spray park facility called the Cypress Spray Park (the "Spray Park"), located on 902 Magnolia Lane; and
WHEREAS, Madison Gas and Electric Company ("MG&E") was asked to install underground electric service to serve the Spray Park facility, and therefore have requested an underground electric line easement, across a portion of the Spray Park, for their underground electric line facilities; and
WHEREAS, City of Madison Parks Division and Office of Real Estate Services staff has reviewed and approve of the granting of said easement.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute an Underground Electric Line Easement to Madison Gas and Electric Company across a portion of the Cypress Spray Park property, legally described as follows:
A strip of land, ten (10) feet in width, located in part of Lot 157, Second Addition to Burr Oaks, lying in part of the Southeast Quarter of the Northwest Quarter of Section 35, Town 7 North, Range 9 East, City of Madison, Dane County, Wisconsin, the centerline of said strip being more particularly described as follows:
The right of way shall be located five (5) feet on the right side and five (5) feet on the left side of the centerline of MG&E's facilities as constructed. The facilities will be located approximately as set forth in the drawing attached hereto as Exhibit A and dated May 9, 2011.
