Authorizing the Director of Information Technology to Transfer Certain City-Owned Conduit, Fiber and Related Infrastructure to MUFN-C or its Members When it No Longer Serves the City’s Needs.

Body
WHEREAS, the City is a founding member of the Metropolitan Unified Fiber Network Consortium (“MUFN-C”), a consortium of public and private organizations which exists to coordinate, create and operate fiber-optic based broadband systems in the Madison area; and,

WHEREAS, as part of the City’s own broadband network, much of which is also part of the MUFN-C network under the terms of the 2013 Facilities Use and License Agreement with MUFN-C, the City has, over time, constructed fiber infrastructure, including conduit, fiber, switches, handholes and other related infrastructure, in the right-of-way and on City-owned property in order to meet the City’s needs. Such infrastructure includes the fiber backbone, but also fiber laterals to serve specific City related sites; and,

WHEREAS, on occasion, due to a change in property use, such as a relocated City facility, or some other factor, the City may find that a portion of its fiber infrastructure is no longer serving the City, but may be of value to MUFN-C or the City’s fellow MUFN-C members; and,

WHEREAS, rather than remove the City’s fiber infrastructure in cases where it no longer serves the City’s interests, it may be appropriate for the City to instead transfer such infrastructure to MUFN-C or its members for their use.

NOW THEREFORE, BE IT HEREBY RESOLVED, that the City’s Director of Information Technology, upon making a determination that a specific portion of the City’s fiber infrastructure (including conduit, fiber and related infrastructure) no longer serves or will serve the City’s needs, may transfer the fiber infrastructure to MUFN-C or its members when determined to be in the public’s interest, subject to approval as to form by the City Attorney, and any ...
