WHEREAS, the City Engineering Division is reconstructing the Yahara Bridge at North Thornton Avenue and East Johnson Street, near 101 North Thornton Avenue; and

WHEREAS, Charter Communications is required to remove their existing overhead telecommunication line from the Yahara Bridge and relocate it underground; and

WHEREAS, Charter Communications has requested a (10) foot wide underground telecommunication easement ("Easement") across the City-owned Park property, in order to relocate their existing overhead telecommunication line; and

WHEREAS, the City Parks Division has reviewed and approves of the Easement.

NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute an Underground Telecommunications Easement with Charter Communications - CCVIII LLC for the Easement described as follows:

A strip of land being ten (10) feet in width, located in part of Blocks 221, 222 and 223, Original Plat, City of Madison, lying part of the SE? of Section 12, Town 7 North, Range 9 East, City of Madison, Dane County, Wisconsin, the centerline of said strip 10-foot-wide strip being more particularly described as follows:




Commencing at the East ? corner of said Section 12; thence North 00°19'47"W along the East line of said SE ?, 1586.49 feet to a point being on the Southeasterly right-of-way line of East Johnson Street per Dane County Survey No. 94-0198; thence S48°23'37"W along said Southeasterly right-of-way line, 242.09 feet to the point of beginning of the hereinafter described easement centerline; thence S03°28'47"E, 21.89 feet to a point; thence S50°30'54"E, 68.22 feet to a point; thence S28°16'44"W, 203.60 feet to a point bei...
