The proposed indemnification language limits the City's liability exposure to a maximum of $75,000 per potential claim. The Risk Manager's recommendation is that the City Self-insure this risk at the present time. No anticipated budgetary impact for this agreement.

Body
The City is proposing to construct a shared use path, including new overpass of Park Street and Murray Street, which will connect the existing Southwest path at Randall Avenue with the Brittingham Path at North Shore Drive. The project will provide a safe and direct route for bicycles and pedestrians into downtown Madison and complete an important link in the City's bike and pedestrian network. Funding for the project is considered under a separate resolution.

A previous Resolution (No. 59999, ID 34362) was adopted July 2, 2003 authorizing a Three Party Design Services agreement with Wisconsin Department of Transportation and Strand Associates, Inc. for design services.

A previous Resolution (No. 60720, ID 32961) was adopted December 3, 2002 authorizing a cost sharing agreement with Wisconsin Department of Transportation for the design phase of this project. A separate resolution (pending) authorizes construction costs.

The proposed path, for approximately 40% of its length, will occupy property owned by WisDOT Bureau of Rails and Harbors and will share use of the corridor with active rail, currently operated by Wisconsin & Southern Railroad Company.

The proposed path is an extension of the existing Southwest path which occupies WisDOT Bureau of Rails property under a similar agreement approved by previous resolution (No. 57159, ID 27317) adopted April...
