Authorizing the execution of an Underground Utility Easement to Wisconsin Bell, d/b/a AT&T, across a portion of Elizabeth Link Peace Park located at 229 West Gilman Street.
Body
WHEREAS, in connection with the recent reconstruction of Elizabeth Link Peace Park (the “Park”), Wisconsin Bell d/b/a AT&T (“AT&T”) was required to relocate its underground telecommunication facilities to a new location within the Park; and

WHEREAS, AT&T has requested a ten (10) foot wide underground telecommunication line easement; (“Easement”) within the Park to accommodate such relocated facilities; and

WHEREAS, the City Parks Division has reviewed and approves of the Easement.

NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute an Underground Telecommunications Easement to Wisconsin Bell, d/b/a AT&T, for the easement described as follows:

A ten (10) foot wide strip of land within Elizabeth Link Peace Park, located at 229 West Gilman Street and more particularly described below (the “Park”). The centerline of the easement area shall be the centerline of AT&T’s facilities located within the Park, as depicted on attached Exhibit A.

Description of the Park:
Part of Lots 1-4, Block 58, Original Plat of the City of Madison, described as follows:

Commencing at the Southwest corner of said Block 58; thence North 46 Degrees 17 Minutes 53 Seconds East, 90.00 feet along the Southeasterly line of Gilman Street to the point of beginning: thence North 46 Degrees 17 Minutes 53 Seconds E, 120.88 feet Along the Southeasterly line of Gilman Street to the North corner of Lot 3, Block 58; thence North 46 Degrees 17 Minutes 53 Seconds East, 30.00 feet along the Southeasterly line of Gilman Street; thence South 43 Degrees 57 Minutes 18 Seconds East, 132.66 feet to the Southeasterly line of Lot 4, Block 58; thence South 46 Degrees 11 Minutes 47 Seconds West, 30...
