SUBSTITUTE: Amending Sections 28.135 and16.23(6)(d) and creating 28.031(7) of the Madison General Ordinances related to Deep Residential Lots to facilitate easier development.

DRAFTER’S ANALYSIS: This proposed ordinance change amends MGO Secs. 28.135 and 16.23(6)(d) to facilitate the easier development of backyard lots, otherwise known as “flag lots” because they are characterized by being the shape of a flag. The pole portion of the lot provides the street frontage and the flag portion provides the buildable area of the lot. This ordinance amendment decreases the minimum lot width for the rear lot and removes Plan Commission review of this type of lot. It also amends the subdivision requirements to make the minimum required lot depth consistent for all zoning districts.
The SUBSTITUTE changes the minimum average depth listed in MGO Sec. 16.23(6)(d) from eighty (80) feet to seventy-five (75) feet and adds a standard fifteen (15) foot front setback for the new backyard lot in MGO Sec. 28.031(7). As lots get smaller, the location of any existing structures becomes a more relevant factor when considering where the lot division could take place because both lots need to meet front and rear setbacks. Depending on the zoning district today, these lots would be required to have anywhere from a fifteen (15) foot to thirty (30) foot front yard setback. Incorporating this smaller front setback for all backyard lots would help provide a bit of flexibility as a property owner factors in all of the other required dimensions for a new lot.
