Accepting a Permanent Limited Easement for Public Sidewalk purposes from Bankstar, LLC.
Body
WHEREAS, the City of Madison Sidewalk and Curb and Gutter program includes extending the existing sidewalk along Old Sauk Road and installing new sidewalk going north along the east side of Excelsior Drive; and
WHEREAS, in order to align with the existing sidewalk and to protect and save existing trees, the City Engineering Division plans to install sidewalk of varying widths, some of which will be outside of the right-of-way; and
WHEREAS, the property owner wishes to give, and the City Engineering Division wishes to accept, an Easement to accommodate the alignment situation and save the existing trees,
NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of Madison hereby accepts a Permanent Limited Easement for Sidewalk purposes, at no cost to the City, from Bankstar, LLC across the parcel as described below:
Part of Lot 6, Old Sauk Trails Park, recorded 21st January, 1986 in Volume 55 of Plats Page 45-46 as Document No. 1918426, being located in the Southeast one-quarter (1/4) of the Southeast one-quarter (1/4) of Section 15, Town 7 North, Range 8 East, City of Madison, Dane County, Wisconsin, more particularly described as follows:
Commencing at the Northwest Corner of said Lot 6, said point also being on the East right-of-Way of Excelsior Drive as platted by the Old Sauk Trails Park; thence South 13°16’34” West, along said existing platted East right-of-way of Excelsior Drive, 154.02 feet to a point of curve and the point of beginning: thence continuing Southwesterly along said platted East right-of-way of Excelsior Drive on the arc of a curve to the left which has a radius of 565.00 feet and a long chord which bears South 06°14’28” West, 138.40 feet, to a point of tangency; thence South 00°47’38” East, along said existing platted East right-of-way of Excelsior Drive, 43.97 feet, to a point on the Nor...
