Authorizing the City of Madison’s Mayor and Clerk to grant a Permanent Limited Easement for Public Water Main Purposes to the City of Fitchburg over a portion of Huegel Park located at 5902 Williamsburg Way. (20th A.D.)
Body
WHEREAS, The City of Madison (“Madison”) is the owner of Huegel Park located at 5902 Williamsburg Way (“Property”); and
WHEREAS, Madison Communication File ID 42792, adopted on May 11, 2016 approved the City of Fitchburg’s (“Fitchburg”) request to Madison for a temporary land use permit (“Permit”) to construct water main facilities (“Facilities”) on a portion of the Property to provide water in between a structure located in Fitchburg’s adjacent Jamestown Park, and an existing ice skating rink on the Property; and
WHEREAS, a condition of approval for the Permit is the subsequent recording of a Permanent Limited Easement for Water purposes (“Easement”), at no cost to Fitchburg, to establish Fitchburg’s right to access and maintain the recently constructed Facilities that now exist without the benefit of easement rights; and
WHEREAS, Madison and Fitchburg mutually agree to the location of the Easement, as depicted on attached Exhibit A.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to grant a Permanent Limited Easement for Water Purposes to Fitchburg for existing Facilities located on a portion of the Property, as legally described below and depicted on attached Exhibit A.

Part of Lot 1094, Hill View Addition to Meadowood, and part of Lot 24, Huegel School Addition to Meadowood in the Southeast Quarter of the Northeast Quarter of Section 1, Township 06 North, Range 08 East, City of Madison, Dane County, Wisconsin as more particularly described below.
