Authorizing the Mayor and City Clerk to execute an agreement with the State of Wisconsin Department of Transportation for Maintenance of the Nelson Road to Terra Court Bicycle/Pedestrian Path.

PREAMBLE
The Nelson Road to Terra Court Bicycle/Pedestrian Path will provide a safe route for bicycles and pedestrians parallel to East Washington Avenue (USH 151) from the American Parkway interchange to the local street system in the City of Sun Prairie. This path will be constructed by the State of Wisconsin Department of Transportation (WisDOT) at no expense to the City of Madison. The path lies almost entirely within WisDOT right of way for USH 151.
WisDOT agrees to allow the path to occupy their right of way, and to resurface or replace the pavement as needed in the future with the understanding that the City would assume responsibility for routine maintenance of the path corridor, including mowing and winter snow removal at the discretion of the City. WisDOT retains responsibility for any fencing between the path and the highway, and authority for permitting of utilities as well as all other property interests within their right of way. This agreement covers only that segment of the path lying within the corporate limits of Madison.
NOW THEREFORE BE IT RESOLVED
That the Mayor and City Clerk are hereby authorized to execute an agreement with the State of Wisconsin Department of Transportation for maintenance of that segment of the Nelson Road to Terra Court Bicycle/Pedestrian Path lying within the corporate limits of the City of Madison.
