PREAMBLE
WHEREAS, in the Spring of 2002, City Engineering received a request for sanitary sewer service from a home at 3378 Shawn Trail, in the Town of Middleton, who had a failing septic tank. To extend service, City Engineering obtained an easement over unplatted lands owned by Attic Angel Prairie Point Inc., formed an assessment district, and established assessments. Subsequently the Town property lost interest and did not pursue annexation or any further request for service. Now Attic Angel Prairie Point, Inc. is preparing to develop the unplatted lands and shall extend sewer to the City limits with their development. Therefore, the assessable City project is no longer contemplated and will not be needed.
NOW, THEREFORE, BE IT RESOLVED, that Resolution No. 59578, ID No. 32066, adopted on 7/16/02 approving plans, specifications, and schedule of assessments for Shawn Trail (South) Sewer Assessment District hereby be rescinded.
