Title
Authorizing the grant to Madison Gas and Electric Company of an Underground Gas Main Easement across the public greenway located at 1701-1703 Fish Hatchery Road.
Body
WHEREAS, Madison Gas and Electric Company ("MG&E") has agreed to relocate, at no cost to the City, MG&E's underground gas main facilities ("Facilities") located within the Park Street public right-of-way in the vicinity of Wingra Creek to accommodate the City's dredging of Wingra Creek pursuant to City of Madison Engineering Project No. 53W0311; and
WHEREAS, MG&E has requested an easement to accommodate the proposed new location of the Facilities in the adjacent public greenway; and
WHEREAS, City Engineering Division staff have reviewed and approve of the granting of such easement.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute an Underground Gas Main Easement to Madison Gas and Electric Company for the
"Easement Area" described below and depicted on attached Exhibit A.
Easement Area:
A strip of land, ten (10) feet in width, located in part of the SW ¼ of Section 26, T7N-R9E, City of Madison, Dane County, Wisconsin, the centerline of said strip being more particularly described as follows:
Commencing at the northwest corner of Certified Survey Map No. 4420, Document No. 1842428 in Volume 19, Pages 88 and 89 of Certified Survey Maps as recorded at the Dane County Register of Deeds Office; thence N88°22'19"E, 337 feet, more or less, to the northerly right-of-way line of Plaenert Drive and point of beginning; thence N09°52'15"E, 94 feet; thence S80°23'16"E, 47 feet, more or less, to the point of termination at the westerly right-of-way line of South Park Street.
