Providing the consent of the City of Madison for George and Gregg Vestesnik (d/b/a Mad City Sports) to locate a recreational vehicle dealership that includes motorcycle sales and rentals on Lots 23 through 26 of the Interstate Commerce Park.

PREAMBLE
The City of Madison was the owner of certain property described as Lots 16 through 25 in the Interstate Commerce Park ("ICP"). The City entered into an Agreement to Purchase and Undertake Development of the Interstate Commerce Park under which the Developers would purchase and develop the ICP as an industrial park. The conditions in the Common Council approval of the ICP plat and Zoning Map amendment did not allow motorcycle sales and rentals. Additionally, the ICP is subject to certain restrictions set forth in the Interstate Commerce Park Declaration of Covenants, Conditions, and Restrictions (recorded with the Dane County Register of Deeds Office on November 30, 2005 as Document 4137948) that provide in part that the ICP shall not be used for "motorcycle sale and rental". George and Gregg Vestesnik (d/b/a Mad City Sports) have entered into a contract with the Developers ("Contract") to buy Lots 25 and 26 with an option to buy Lots 23 and 24 for the purpose of constructing improvements to operate a power sports recreational vehicle dealership including motorcycles. The Contract contains a contingency whereby Mad City Sports has to obtain the necessary zoning approvals to allow it to construct improvements to operate a power sports recreational vehicle dealership including motorcycle sales and rentals. The City Zoning Administrator and the Director of Planning have reviewed the proposed use and support providing consent for the construction of improvements for the operation of a power sports recreational vehicle dealership that includes motorcycle sales and rentals on Lots 23 through 26 of the ICP.
