Approximately $713,000 is available in the Contingent Reserve to fund the $25,000 expenditure authorized by this resolution. There is no impact on the tax levy or eligibility under the state expenditure restraint program.

Body
By Resolution No. 61643, ID No. 36308, the Common Council authorized the City to retain the firm of Godfrey & Kahn (attorneys Jon Anderson, Todd Smith, and Rochelle Klaskin) to advise the City on concerns relating to the Fire Department's Daily Staff Equalizations as it relates to the Fair Labor Standards Act.
The City appropriated $15,000 for estimated costs in the previous resolution which was adopted on July 6, 2004.  That amount was supplemented by an additional $10,000 in March, 2005 (Legistar File No. 00662, RES-05-00241).  The litigation continues.  This appropriation has lasted well into 2006, but is now nearly depleted.  Estimated costs for the remainder of the case will be approximately $25,000.
NOW, THEREFORE, BE IT RESOLVED that the Common Council authorizes the sum of $25,000 to be appropriated from the Contingent Reserve to the Miscellaneous Litigation account for the City's continued defense of the Fair Labor Standards Act claims as it relates to the Madison Fire Department and Firefighters Local 311.
