Approving a maintenance agreement for privately maintained improvements within the public right of way (within Portia Court as part of the Grandview Commons Subdivision improvements for Phase 10).  (3rd AD)
Body
WHEREAS, the property owner, Premium Real Estate, LLC has requested to have a landscaping island installed within Portia Court as part of the Grandview Commons Subdivision improvements for Phase 10, Engineering Project Number 53B1971, Contract No. 1971, and,
 
WHEREAS, Premium Real Estate, LLC was required to enter into a maintenance agreement with the City per the Subdivision Contract No. 1971, for said improvements of way to insure the public's long term use and function of the landscaping within the island as requested, and;
 
WHEREAS, the Premium Real Estate, LLC has directed Grandview Commons Homeowner's Association, Inc. to enter into the maintenance agreement with the City of Madison for the perpetual maintenance of the landscape island on Portia Court.
 
 
NOW, THEREFORE, BE IT RESOLVED:
 
1.      That the Mayor and City Clerk are hereby authorized and directed to execute an agreement between The City of Madison and Grandview Commons Homeowner's Association, Inc.  for the maintenance of portions of the public right of way Portia Court.
