Title
Authorizing the execution of a Release of an Off-Site Advertising Sign Restriction to Plan D Investment LLC and Apex Investment Group VIII LLC, for their properties located at 6201 and 6109 Odana Road, respectively.
Body
WHEREAS, the Plan D Investments LLC and Apex Investment Group VIII LLC (jointly "Owners") are the owners of certain properties legally described as Lots 1 and 2, Certified Survey Map No. 2777, located at 6201 and 6109 Odana Road, respectively; and
WHEREAS, the City of Madison ("City") approved said Certified Survey Map, as recorded on April 7, 1978 recorded as Document Number 1566060, in the Dane County Registry; and
WHEREAS, said Certified Survey Map included a notation that prohibited "off-site advertising signs" on all lands included in said Certified Survey Map; and
WHEREAS, The City Attorney's Office has advised that this offsite advertising sign restriction is not applicable anymore due to current zoning codes and City settlement agreements with local sign companies, and have requested that the City Office of Real Estate Services record a Release of Offsite Advertising Sign Restriction, which would eliminate the offsite advertising sign restriction encumbering said Lot 1 and 2 of said Certified Survey Map; and
WHEREAS, City of Madison Attorney's Office, Zoning Office, and Office of Real Estate Services staff have reviewed and approve of the granting of said release.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute a Release of Offsite Advertising Signs Restriction to Plan D Investment LLC and Apex Investment Group VIII LLC, legally described as follows:
Lot 1 and 2, Certified Survey Map No. 2777, recorded on April 7, 1978 as Document Number 1566060, in the Dane County Register of Deeds Office, City of Madison, Dane County, Wisconsin.
