Authorizing the Clerk to issue a summons to Orpheum Theatre Company of Madison, Inc., dba Orpheum Theatre, Eric Flemming, agent, to appear before the Alcohol License Review Committee.
Body
WHEREAS, a complaint has been filed with the Common Council by Assistant City Attorney Jennifer Zilavy against Orpheum Theatre Company of Madison, Inc., dba Orpheum Theatre, Eric Flemming, agent, located at 216 State Street, Madison, WI; and
WHEREAS, said complain avers that Orpheum Theatre Company of Madison, Inc., dba Orpheum Theatre, Eric Flemming, agent, has exceeded 200 points of liquor law violations rendering any issuance of a Formal Expression of concern, within the meaning of Sec. 38.10(4)(d), Madison General Ordinances, inapplicable; and
WHEREAS, Orpheum Theatre Company of Madison, Inc., dba Orpheum Theatre, Eric Flemming, agent, currently holds a Class B Combination alcohol beverage license which expires on June 30, 2007, and has held Class B Combination alcohol beverage licenses issued by the city of Madison on the date of the alleged violations; and
WHEREAS, Sec. 38.10(1)(a) authorizes the Common Council to issue a summons when a complaint has been filed.
NOW THEREFORE BE IT RESOLVED that the City Clerk is hereby directed to issue a Summons to Orpheum Theatre Company of Madison, Inc., dba Orpheum Theatre, Eric Flemming, agent, to appear before the Alcohol License Review Committee at its June 20, 2007, meeting.
