Creating Section 24.02(4) of the Madison General Ordinances to create an exception to the disorderly conduct ordinance for a concealed weapon.

DRAFTER'S ANALYSIS:  This ordinance creates an exception to the disorderly conduct ordinance which states that the carrying or loading of a firearm without any malicious intent is not disorderly conduct.  This exception is required under 2011 Wisconsin Act 35.

The Common Council of the City of Madison do hereby ordain as follows:
Subsection (4) entitled "Exception" of Section 24.02 entitled "Disorderly Conduct" of the Madison General Ordinances is created to read as follows:
"(4)      Exception.  It is not a violation of this section if the only behavior observed is the loading, carrying or going armed with a firearm, regardless as to whether the firearm is loaded or concealed or openly carried.  This exception does not apply if there are facts and circumstances that indicate a criminal or malicious intent on the part of the individual with the firearm."
