PREAMBLE
WHEREAS on March 20, 2007 the Common Council of the City of Madison adopted Resolution No.RES-07-00350, File No.05654, approving relocation order for the acquisition of several properties needed for construction improvements for Hanson Road and Portage Road from Manufacturer Drive to Interstate Highway 39/90/94. The relocation order included the partial acquisition of 35,284 square feet of a 2.8 acre Madison Gas and Electric's (MG&E.) parcel located at 4014 Hanson Road.
WHEREAS the partial acquisition includes a MG&E storage facility.
WHEREAS as a result of the partial acquisition, the remaining 2-acre parcel of land is of no utility to MG&E.
WHEREAS, MG&E has requested that the City acquire the entire 2.8-acre property including the storage facility.
WHEREAS, the $245,000 negotiated acquisition price is supported by two independent appraisals.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Madison authorizes the acceptance of an Offer to Sell from Madison Gas and Electric Company (the "Seller") for property located at 4014 Hanson Road (the "Property"), to complete the anticipated improvements to Hanson and Portage Roads.
BE IT FURTHER RESOLVED that the conditions of the sale include the following:
· The purchase price for the property shall be $245,000.00.
· The closing shall occur on or before November 1, 2007.
· The City shall pay applicable closing costs not to exceed $ 5,000.00
