Approving Addendum No. 1 to the Subdivision Contract for Linden Park - Phase 6, Contract No. 2204. (1st AD)

WHEREAS, on September 19, 2008 the developer, Great Neighborhoods West, LLC., had entered into a Contract for the Construction of Public Improvements That Will be Accepted by the City of Madison with the City of Madison and,
WHEREAS, the Contract did not provide for reimbursement of street infrastructure costs the Developer constructed adjacent to City owned lands.
NOW, THEREFORE, BE IT RESOLVED:
1. That the Mayor and City Clerk are hereby authorized and directed to execute Addendum No. 1 for Linden Park Phase 6, Contract No. 2204 with Great Neighborhoods West, LLC., to provide reimbursement for streets infrastructure constructed adjacent to City owned lands.
2. That the developer is authorized to construct the public improvements in accordance with the terms of the Contract for the Construction of Public Improvements That Will be Accepted by the City of Madison the sole cost of the developer, except as follows: Reimbursement not to exceed the statutory limit for the cost of street improvements that benefit the City and abut lands owned by the City, in accordance with Section 16.23(9)(d)(6)(d).
