Amending Sections 9.05(5) and (7)(b) and Section 38.11(2) of the Madison General Ordinances to correct an inconsistency and make the initial and renewal license fees for adult entertainment establishments and adult entertainment taverns the same.

DRAFTER'S ANALYSIS: This amendment corrects an inconsistency in license fees between sec. 38.11, which establishes license conditions for Adult Entertainment Tavern Licenses, and sec. 9.05, which establishes the licensing and renewal procedures for both an Adult Entertainment Tavern license and an Adult Entertainment Establishment license.
This amendment raises the initial fee for both licenses to $600. An ordinance amendment in 2004 (Ord # 13,601) raised the renewal fee for both licenses to $600, and increased the Tavern license to $600 in sec. 38.11 but did not make the same change to 9.05. This amendment corrects that problem and creates a cross reference between 38.11 and 9.05 to avoid inconsistencies in the future.

The Common Council of the City of Madison do hereby ordain as follows:
1. Subsection (5) entitled "Fees" of Section 9.05 entitled "Adult Entertainment Establishments and Adult Entertainment Taverns" of the Madison General Ordinances is amended to read as follows:
"(5) Fees. A license fee of four hundred dollars ($400) six hundred dollars ($600) shall be submitted with the application for an adult entertainment establishment license or five hundred dollars ($500 ) for an adult entertainment tavern license. If the application is denied, one half of the fee shall be returned."
2. Subdivision (b) of Subsection (7) entitled "Renewal of License of Section 9.05 entitled "Adult Entertainment Establishments and Adult Entertainment Taverns" of the Madison General Ordinances is amended to read as follows
