AMENDED: Amending Section 5.20(3)(a)3. of the Madison General Ordinances related to nominations to the Police Civilian Oversight Board to modify the process for community organizations to nominate members of the PCOB.

DRAFTER’S ANALYSIS: This ordinance modifies the process for community organizations to nominate members of the Police Civilian Oversight Board (PCOB). The current ordinance requires that designated community organizations submit three names for consideration by the Mayor and Council and allows the Mayor and Council Leadership to make an appointment from a pool of other eligible applicants if the organization does not submit three names. The PCOB was established in 2020 and the terms of some of the original members have expired or will expire shortly. This ordinance would permit designated organizations to re-nominate an individual who it had previously nominated and whose term is expiring if that individual is interested in continuing to serve, rather than submitting names of two additional individuals in addition to the incumbent’s name.
The amendment reduces required nominations by community-based organizations from three (3) to two (2) when an incumbent Board member is not re-nominated.

The Common Council of the City of Madison do hereby ordain as follows:
1. Paragraph 3. of Subdivision (a) entitled “Members” of Subsection (3) entitled “Board Composition” of Section 5.20 entitled “Police Civilian Oversight Board” of the Madison General Ordinances is amended as follows:
“3. Nominated by community-based organizations. The Mayor and Common Council, in collaboration with the Department of Civil Rights, shall seek nominations from a designated set of nine (9) community-based organizations that have an interest in civil rights, immigrant rights, disability rights/mental health, racial equity and social justice, and that also have an interest in the safety of the city and criminal justice reform. Priority shall be given to organizations with budgets under $1 million. The designated set of organizations shall be initially created in conjunction with the adoption of this Ordinance and the Monitor, Board, and Common Council shall ensure that it is updated at least every two (2) years. Each community-based organization shall submit three (3) two (2) names and applications to the Mayor and Common Council, except that an organization may re-nominate a member whose term is expiring without submitting three names. The Mayor and Common Council shall appoint one (1) person nominated by each organization. In the event that a community organization or organizations does not submit three (3) two (2) nominations when requested or does not re-nominate a current member, the Mayor and Council Leadership shall make an appointment from the pool of any eligible applications to submit for confirmation to the Common Council.”
