This grant will be accounted for in a segregated fund (SG64) and is not subject to the Expenditure Restraint Program limits. Matching funds are not required. The City's existing insurance policy protects the City from the risk imposed by the indemnification provision.

The State of Wisconsin Office of Justice Assistance has awarded the City of Madison $280,000 for the Fire Department Heavy Rescue Team. There is no matching requirement with this grant.
The grant is awarded for a heavy rescue trailer, technical rescue equipment, and personal protective equipment. This equipment may be utilized at building collapses, natural disasters and Weapons of Mass Destruction (WMD) responses. The grant budget covers the following:

The Office of Justice Assistance Homeland Security Program Grant Award contains a provision which requires the City to indemnify, defend and hold harmless the State and all of its officers, agents, and employees from all suits, actions or claims of any character brought for or on account of injuries or damages received by any persons or property resulting from the operation or use by (the Grantee) of the equipment purchased under the grant. Pursuant to APM 1-1, the inclusion of such a provision requires the express approval of the Common Council.
NOW THEREFORE, BE IT RESOLVED that the City approve acceptance of the $280,000 from the State of Wisconsin Department of Office of Justice Assistance, and,
BE IT STILL FURTHER RESOLVED THAT the grant award documents will contain idemnification provisions negotiated by and acceptable to the City Attorney and the Risk Manager; and that the Risk Manager is instructed to purchase appropriate insurance to protect the City from the risk imposed by the idemnification provisions in the event it is concluded that such is not already covered under existing policies as an insured contract, and
BE IT STILL FURTHER RESOLVED THAT the Mayor and other City officials are authorized to execute necessary grant documents.
