Body
WHEREAS, Robert H. Fillingame and Kathy A Schlimgen, the owners of the property at 5046 Lake Mendota Drive, have requested the release of a portion of the sanitary sewer easement located within said property in order to build a small boat storage garage; and
 
WHEREAS, the existing sanitary sewer easement is a 20-foot wide easement extending ten-feet on each side of the sewer line; and
 
WHEREAS, the easement release of 2.5 feet on the South side of the sewer would reduce the easement to 7.5 feet and permit building of the boat storage facility; and
 
WHEREAS,  the City Engineering Division has reviewed and recommends the partial release of the sanitary sewer easement by the City.
 
NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are authorized to execute a partial release of the platted public sanitary sewer easement being part of Lot 38, Block 1, Spring Harbor, and part of Lot 3, Block 2, Spring Park, City of Madison, Dane County, Wisconsin more fully described as follows:
 
The Southerly 2.5 feet of an existing Public Sanitary Easement, recorded in Document 3377664, Dane County Register of Deeds, described by metes and bounds as:
Commencing at the Southeast corner of said Lot 38;
Thence N 00º04'30" W, 54.80 feet along the east lline of said Lot 38;
Thence N 15º31'15" E, 11.03' along a property line to a point on an existing sanitary sewer easement line, being ten feet southerly of the centerline of a sanitary sewer, being the POINT OF BEGINNING of this Description;
Thence N 70º20'25" W, 33.12 feet, parallel with the sanitary sewer to a property line;
Thence N 15º43'12" E, 2.51 feet along a property line;
Thence S 70º20' 25" E, 33.11 feet to a property line;
Thence S 15º31'15" W, 2.51 feet to the POINT OF BEGINNING of the Description.
