Title
To suspend the Class B Combination alcohol beverage license granted to Kollege Klub, Inc., dba Kollege Klub Bruce Meier, agent, 529 N. Lake Street Madison, Wisconsin, for five (5) days.
Body
WHEREAS, on or about June 5, 2007, a complaint was filed by Assistant City Attorney Jennifer Zilavy of the Madison City Attorney's Office alleging seven (7) counts of PERMIT UNDERAGE PERSON ON LICENSED PREMISE, in violation of Sec. 38.04(3)(b) of the Madison General Ordinances; three (3) counts of SELLING ALCOHOL BEVERAGES TO UNDERAGE PERSON, in violation of Sec. 38.04(1)(a)2 of the Madison General Ordinances; one (1) count of PERMITTING INTOXICATED PERSON ON PREMISES, in violation of Sec. 38.04(2)(a)3 of the Madison General Ordinances; two (2) counts of VIOLATION OF LICENSE CONDITION (CAPACITY), in violation of Sec. 38.12(1)(a) of the Madison General Ordinances; and one (1) count of SELLING TO INTOXICATED PERSON, in violation of Sec. 38.04(2)(a)2 of the Madison General Ordinances, at the premises known as Kollege Klub, 529 N. Lake Street, Madison, Wisconsin; and
WHEREAS, pursuant to Sec. 38.10 of the Madison General Ordinances, Assistant City Attorney Jennifer Zilavy and Bruce Meier, owner and agent for Kollege Klub, Inc., entered into a stipulation regarding disposition of this case and agreeing that Kollege Klub would have its Class B Combination alcohol beverage license suspended for a period of five (5) days; and
WHEREAS, Kollege Klub was assessed a forfeiture in the accompanying municipal court action in the amount of three thousand eight hundred twenty six dollars ($3,826.00); and
WHEREAS, the parties agreed that Kollege Klub employees would confiscate all false ID cards presented for entry into the establishment and present such confiscated ID cards to a member of the Madison Police Department's Central District Community Policing Team on a monthly basis; and
WHEREAS, the parties agreed that by October 1, 2007, all Kollege Klub employees who have not done so in the last two (2) years, would attend the Madison Police Department's Tavern Safety Training; and
WHEREAS, the parties agreed that Kollege Klub would discontinue offering "all you can drink" specials; and
WHEREAS, the parties agreed that Kollege Klub would install a tape measure at the front door of the establishment for purposes of determining patrons' heights to aid in the detection of patrons submitting false ID's for entrance; and
WHEREAS, the parties agreed that Kollege Klub would utilize a black light at the front door for purposes of attempting to verify ID's submitted for entrance into the establishment; and
WHEREAS, the parties have agreed that Kollege Klub may not be open to the public for any purpose during the period of suspension and may not in any way utilize its Class B Combination alcohol beverage license during the term of suspension,
WHEREAS, the Alcohol License Review Committee approved the stipulation and ordered that the five (5) day suspension would begin at 2:01 a.m. on September 6, 2007 and end at 2:01 a.m. on September 11, 2007.
NOW THEREFORE, BE IT RESOLVED, that the Common Council accepts the stipulation of the parties and the recommendation of the Alcohol License Review Committee and hereby suspends the Class B Combination alcohol beverage license granted to Kollege Klub, Inc., dba Kollege Klub, Bruce Meier, agent, 529 N. Lake Street, Madison, Wisconsin, commencing at 2:01 a.m. on September 6, 2007 and ending at 2:01 a.m. on September 11, 2007.
