The proposed resolution amends Section 4.08(1)(d) of the Madison General Ordiances to allow for longer periods for installment payments of special assessments for customers of private water supply cooperatives. Under the current ordiance, public improvement projects have a 30-year installment payment for the water portion of special assessments and a 15-year period for the remainder of the improvements. The proposed amendment simplifies the billing process for property owners and the City by allowing for a 30-year payment period for all special assessments. No appropriation is required.

DRAFTER’S ANALYSIS: This ordinance amendment updates the special assessment installment language, allowing all assessable project costs (street and sanitary) associated with a water main project to serve properties provided water service by a private water cooperative to be collected in 30-installment periods. Without this amendment, the same public improvement project would have two maximum collection periods, a 30-year period for the water portion and a 15-year portion for the rest of the improvements. By allowing a 30-year period for the entire project, the City’s assessment finalization and billing process will be simplified, both for the City and the property owners.

The Common Council of the City of Madison do hereby ordain as follows:
1. Subdivision (d) of Subsection (1) of Section 4.08 entitled “Special Assessments-Payment in Installments” of the Madison General Ordinances is amended as follows:
“(d) Thirty (30), where the special assessments are being levied to fund a water main to serve properties provided private water service by a private water supply cooperative, as defined in Sec. 13.07(2)(b)8, including any other special assessments for public improvements being constructed in coordination with the water main.”
