Fiscal Note
In the adopted 2017 capital budget Engineering-Pedestrian/Bicycle has budgeted $2,316,000 to repair defective sidewalk within the Sidewalk Program (MUNIS 10148). Aldermanic Districts 15 and 17 are receiving these sidewalk improvements in 2017. This resolution approves the order of sidewalk repair and replacement to property owners at a total estimated cost of $2,095,000 of which $785,000 is funded via assessments and $1,310,00 funded by GO Borrowing.

Title
Ordering Property Owners to Repair or Replace Substandard and Defective Sidewalks in the 15th and 17th Aldermanic Districts.
Body
WHEREAS, pursuant to City policy, each year the City Engineer causes existing sidewalks in two aldermanic districts to be inspected for unsafe or defective conditions, and conditions that do not meet City standards, which policy results in every existing sidewalk being subject to repair or replacement every 10-years; and,
WHEREAS, pursuant to Wis. Stat. Sec. 66.0907, and MGO Secs. 10.09 and 4.09(12), upon learning of unsafe, defective or insufficient sidewalks, the City orders the adjoining property owner to repair or replace the sidewalk and performs the work if not done, charging the amount to the property owners as a special tax; and,
WHEREAS, in 2016 City Engineering staff inspected the sidewalks in the 15th and 17th Aldermanic Districts, hereinafter described, and detailed the sidewalks in need of repair or replacement, which work is to be done in 2017.
NOW THEREFORE, BE IT HEREBY RESOLVED that the Board of Public Works, pursuant to its authority in Wis. Stat. Sec. 66.0907(3)(b), is authorized to order property owners in the 15th and 17th Aldermanic Districts adjacent to sidewalks in need of repair or replacement to replace and or repair sidewalks, or parts thereof, in full compliance with the requirements of the Ordinances governing such construction and repair.
BE IF FURTHER RESOLVED that firm arrangements for such construction shall be made by the date specified on the Sidewalk Notice, and that if arrangements are not made by the aforesaid date, the City of Madison, will cause such sidewalk to be replaced or repaired and charge the cost thereof to the property in front of which the walk was repaired or replaced and such cost, unless previously paid, will be collected as a special tax against the property in front of which the walks were repaired or replaced.
EDITOR’S NOTE: Parcels in the 15th and 17th Aldermanic Districts are subject to deletion due to work being done by other City of Madison Contracts, utility work, insufficient funds, or other circumstances which justify deletion.
