Preamble
 
The Wisconsin Department of Transportation (WDOT) has prepared plans for the improvement of the Beltline Highway Frontage Roads in the vicinity of Todd Drive and for the Todd Drive Intersection.   On December 6, 2005 the City of Madison entered into an agreement with the WDOT for cost sharing on the project with the authority provided by RES-05-00910 passed by the CC on 11/15/05.  The resolution also approved the plans and specifications.  
 
The Wisconsin Department of Transportation (WDOT) has prepared the plans and specifications for the Cottage Grove Road Bridge over I 39/90 and the approaches to the bridge.  On February 7, 2006 the City of Madison entered into an agreement with the WDOT for cost sharing on the project with the authority provided by RES-06-00041 passed by the CC on 1/17/06.  The resolution also approved the plans and specifications.
 
Bids have been received for the Todd Drive project and have exceeded the costs shown in the agreements between the City and the WDOT.  The agreement that was executed in December of 2006 called for any overage in costs to be split 50% City and 50% State.  The City has met with the WDOT and the WDOT has proposed to the City that the agreement be revised such that any costs in excess of those costs indicated in the original agreement are to be split 25% City and 75% State.  
 
On August 12, 2003 the City of Madison entered into a Memorandum Of Understanding (MOU) with the WDOT that provided for cost sharing on 4 bridges over the interstate including the Cottage Grove Road Bridge.  In addition the MOU provided for cost sharing on the Marsh Road bridge over the Beltline Highway.  The agreement specified a 75 % state/federal share and a 25% City share for the Cottage Grove Road Bridge.  The agreement also allowed for the advancement of the Marsh Road Bridge over the Beltline Highway by financing an amount in excess of the normal City share in exchange for a credit later on future bridge projects identified in the MOU.  The WDOT did not have sufficient funds available to finance the project at that time.  In accordance with the MOU, the City entered into an agreement with the WDOT for construction of the Marsh Road bridge over the Beltline Highway and funded the local share with funds from TID 24.  The local share for the Cottage Grove Road Bridge was completely offset by the credit due for the Marsh Road Bridge and therefore no City funds were required for the Cottage Grove Road Project.  
 
In accordance with WDOT policy, the credit can only be used on the WDOT Backbone System.  The Beltline Highway is on the Backbone System.
 
The WDOT has proposed to the City that the credit for the Marsh Road Bridge be used entirely on the Todd Drive / Beltline Frontage Road Project and that the City enter into a revised agreement for the Cottage Grove Road Bridge that deletes the credit from that agreement.  The credit is currently estimated at $1,452,123 and the use of that credit on the Todd Drive / Beltline Frontage Road Project will result in a reduction in the amount of City funding needed for the Todd Drive Project in the amount of  $299,423.  The reduction is sufficient to cover the estimated local share of the Cottage Grove Road Bridge Project.   
 
The plans include traffic signals on Todd Drive both north and south of the Beltline where the frontage roads intersect Todd Drive.  The plans also include widening portions of the frontage road to provide space for left turn lanes and bike lanes.  The Wisconsin Department of Transportation is planning to install ramp metering on the west bound on ramp concurrent with this project as well.  
 
Now Therefore be it resolved that the Mayor and City Clerk are hereby authorized to enter into a revised agreement with the Wisconsin Department of Transportation for construction of the South Madison Beltline Todd Drive Interchange, and
 
Be it further resolved that the Mayor and City Clerk are hereby authorized to enter into a revised agreement with the Wisconsin Department of Transportation for the Cottage Grove Road Bridge and Approaches and
 
Be it further resolved that the budget authority and carry forward funds in the amount of $300,000 be transferred from Project 23 to Project 10 (Cottage Grove Road Bridge) in the 2006 Engineering - Major Streets Capital Budget .  The new funding package and budget authorization as described in this resolution will replace that of the 2006 Adopted Capital Budget.
