The proposed resolution authorizes an easement for temporary use and occupation of air space over portions of Breese Stevens Field from April 2026 through June 30, 2027 (approximately 433 days). The proposed easement fee is $50 per day during the estimated easement term easement fee is $50 per day during the estimated easement term for a total estimated easement of $21,650. Easement payments shall be made to the City from Engen Constructions Solutions. Funds will be deposited in the Parks Division's Adopted Operating Budget. No appropriation is required.

Authorizing the City’s grant and execution of a Temporary Construction Easement Agreement between the City of Madison and Engen Construction Solutions, LLC for the temporary use and occupation of air space over portions of Breese Stevens Field, located at 902 E. Washington Ave. (District 6)

WHEREAS, this resolution authorizes a Temporary Construction Easement Agreement (“Easement”) between the City of Madison (“City”) and Engen Construction Solutions, LLC (“Grantee”) to allow the temporary encroachment of a crane swing over City-owned property commonly known a Breese Stevens Field located at 902 E. Washington Avenue (“City Property”), to and for the benefit of a redevelopment project commonly known as Archipelago Village, located across the street at 1 S. Paterson Street (“Development Property”); and
WHEREAS, a tower crane is being used during construction staging on the Development Property and the Grantee requests access over, above and across a portion of the City Property to facilitate a portion of the crane swing radius, as depicted in Exhibit B of the Easement attached hereto; and
WHEREAS, City staff approve of the Easement grant, in accordance with terms and conditions agreed upon by the City and the Grantee, as evidenced by the Grantee’s signature in the Easement attached hereto.
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and the City Clerk are hereby authorized to grant execute the Easement between the City and the Grantee, substantially on the terms and conditions shown in the Easement attached hereto, in a form approved by the City Attorney’s office, together with any other documents that may be necessary to accomplish the intentions of this resolution.
