Fiscal Note

The proposed resolution authorizes the Mayor and City Clerk to enter into a noncompetitive contract for Purchase of Services (Design Professional) with IMEG, Corp. for professional design services to prepare biddable construction documents, specifications, and provide an accurate construction estimate for budgeting purposes in an amount not exceed $498,584. Funding for this project is authorized in the 2025 Parks Division's Adopted Capital Budget (Munis #14708). No additional appropriation is required.

Authorizing a non-competitive contract with IMEG, Inc. for the production of biddable construction documents and specifications for the Bolz Conservatory at Olbrich Botanical Gardens, 3330 Atwood Ave. (District 15).

Body

WHEREAS, in 2024 the Madison Common Council approved RES-24-00257 (File ID 82987) authorizing two non-competitive contracts for professional engineering analysis of structural and glazing components of the Bolz Conservatory; and

 

WHEREAS, the 2024 engineering analysis was completed by IMEG, Inc.; and

 

WHEREAS, the next phase in the project is to complete biddable construction documents, specifications, and provide an accurate construction estimate for budgeting purposes; and

 

WHEREAS, this will require a vendor that is familiar with the Bolz Conservatory structure, previous assessment reports, findings and conditions; and

 

WHEREAS, IMEG, Inc. has worked with the City previously on Olbrich Botanical Gardens and Bolz Conservatory Structural and Mechanical assessments, and is available to do this work in the time frame required for a price of $498,584; and

 

WHEREAS, under sec. 4.26(4)(b), of the Madison General Ordinances if the aggregate amount of the fee for services will be $50,000 or more and the contract was not subject to a competitive bidding process, the contract shall meet one of the other requirements of sec. 4.26(4)(a) and be approved by the Common Council; and

 

WHEREAS, for the reasons stated in the attached Noncompetitive Selection Request Form, the proposed contract with IMEG, Inc. meets the exception to the bidding process in section 4.26(4)(a)7. which states “A particular consultant has provided services to the City on a similar or continuing project in the recent past, and it would be economical to the City on the basis of time and money to retain the same consultant;”

 

NOW THERFORE BE IT RESOLVED, that the Mayor and City Clerk are authorized to execute a services contract not to exceed $498,584 for the above described services without prior approval and contract amendment; and

 

NOW THERFORE BE IT FURTHER RESOLVED, the Mayor and City Clerk are authorized to extend the services contract and approve amendments pending proper budget authority for additional services related to the services noted above or for construction administration of a potential, future Public Works contract relating to the services described above.
