Approving Addendum No. 1 to 3030 Ohmeda Drive CSM, Contract No. 9082 (District 16)

Body

WHEREAS, on June 1, 2022, the developer, Madison Interstate East, LLC, hereinafter the “Developer” had entered into a Contract For the Construction of Public Improvements that will be Accepted by the City of Madison hereinafter the “Contract” with the City of Madison, and;

WHEREAS, the Developer created Lot 1 of Certified Survey Map No. 16276, recorded as Document 5899558, Volume 120, Pages 326 - 333 with the Dane County Register of Deeds on May 4, 2023, and;

WHEREAS, the Developer and the City have since mutually agreed that the water and sanitary sewer lines to service Lot 1 of CSM No 16276 be installed along Femrite Drive instead of installation by the City of Madison in Ohmeda Drive as part Public Works Project No. 13810, Contract No. 8631, and;

WHEREAS, the Developer will service Lot 1 of CSM 16276 by the water and sanitary sewer line which (as provided by the Developer Agreement) Madison Interstate East, LLC will be installing along Femrite Avenue to serve Building 1 (i.e., the structure on Lot 1 of CSM 15956 recorded as Document 5820103, Volume 117, Page 69 by the Dane County Register of Deeds on March 11, 2022).

NOW, THEREFORE, BE IT RESOLVE:

 

1.                     That the Mayor and City Clerk are hereby authorized and directed to execute Addendum No. 1 to 3030 Ohmeda Drive CSM, Contract No. 9082, with Madison Interstate East, LLC.

 

2.                     That the revised plans and specifications for the public improvements necessary to serve this project are hereby approved.

 

3.                     That the developer is authorized to construct the public improvements in accordance with the terms of the Contract For the Construction of Public Improvements That Will be Accepted by the City of Madison at the sole cost of the developer.

 

4.                     That the Mayor and City Clerk are hereby authorized to sign and grant easements or right-of-way release or procurement documents, maintenance agreements or encroachment agreements, as necessary and grant or accept dedication of lands and/or easements from/to the Developer/Owner for public improvements located outside of existing public fee title or easement right-of-ways.

 

5.                     The Common Council is approved to accept ownership of the improvements in the Maintenance Area if a maintenance agreement is executed and recorded as a condition of this contract.
