Authorizing the acceptance of a Permanent Limited Easement for Public Bus Shelter Purposes from AL Land Acquisition, LLC, located 4325 Nakoma Road.
Body
WHEREAS, the AL Land Acquisition, LLC (the “Owner”), is the owner of an improved multi-family property located at 4325 Nakoma Road; and
WHEREAS, the Owner has made application to the City for a demolition permit and conditional use for the construction of a new skilled nursing and assisted living facility at said property; and
WHEREAS, as a condition of approval of said demolition permit and conditional use, Metro Transit required the Owner, and the Owner has agreed, to convey to the City a Permanent Limited Easement for Public Bus Shelter Purposes at said property; and
WHEREAS, Metro Transit staff have reviewed and approve of said easement for public bus shelter purposes, to be located at the Owner’s property at 4325 Nakoma Road.
NOW, THEREFORE, BE IT RESOLVED, that the City of Madison is hereby authorized to accept a Permanent Limited Easement for Public Bus Shelter Purposes from AL Land Acquisition, LLC, for a property located at 4325 Nakoma Road, legally described as follows and depicted on Exhibit A;
A 5 foot wide by 10 foot long easement for a public bus shelter, located in Lot 5, Block 5, First Addition to Crawford Heights, in the NW 1/4 of the SE 1/4 and the SW 1/4 of the NE 1/4 of Section 32, T7N, R9E, in the City of Madison, Dane County, Wisconsin, more particularly described as follows:
Commencing at the Westerly most corner of said Lot 5, thence N 44°14'00" E, along the northwesterly platted boundary line of said Lot 5, 102.95 feet to the point of beginning of this description; thence S 45°46'00" E, 5.00 feet; thence N 44°14'00" E, 10.00 feet; thence N 45°46'00" W, 5.00 feet; thence S 44°14'00" W, along the northwesterly platted boundary line of said Lot 5, 10.00 feet to the point of beginning.
