Title
Amending Sections 40.08(1), 40.08(3) and 40.08(4) of the Madison General Ordinances to make changes regarding the issuance, term and renewal of permits to operate a conveyance.

DRAFTER'S ANALYSIS: This amendment changes the time the Chief has to issue a permit to operate from ten days to thirty days. It also removes the requirement that owners contact the Chief to schedule a periodic inspection. The Chief will schedule periodic inspections according to the Department's schedule. This amendment establishes that the permit to operate expires not from date of issuance but from a date established by the Chief, the permit is an annual permit.

The Common Council of the City of Madison do hereby ordain as follows:
1. Amending Subsection (1) entitled "Issuance" of Section 40.08 entitled "Permits to Operate" of the Madison General Ordinances to read as follows:
"(1) Issuance. No owner may use or operate a conveyance in the City of Madison until an acceptance inspection, periodic inspection, or test of equipment covered by this chapter has been performed by the Chief and the conveyance is found to be in compliance with the provisions of this chapter. Upon finding a conveyance to be in compliance with this chapter, the Chief shall issue a permit to operate within ten (10) thirty (30) business days of the inspection by the Chief provided such inspection demonstrates to the satisfaction of the Chief the equipment complies with the provisions of this chapter."
2. Amending Subsection (3) entitled "Term" of Section 40.08 entitled "Permits to Operate" of the Madison General Ordinances to read as follows:
"(3) Term. The term of any permit to operate shall expire one year from the date of issuancebe for one year, the expiration date shall be established by the Chief."
3. Amending Subsection (4) entitled "Renewal" of Section 40.08 entitled "Permits to Operate" of the Madison General Ordinances to read as follows:
"(4) Renewal.
(a) Six (6) weeks prior to the expiration of the permit to operate, an owner shall renew the permit to operate by scheduling a periodic inspection with the Chief.
(b) Upon performing the inspection, the Chief shall give the owner notice of relevant conveyance safety requirements that must be complied with and shall instruct the owner as to the procedure for obtaining periodic inspections and reviewing the permit under which the conveyance is operated."
