Fiscal Note
The proposed resolution authorizes the Mayor and City Clerk to enter into a contract for Purchase of Services with OPN Architects, Inc. to provide professional architectural and engineering consultant design services and construction administrative services for the design and construction of the Fire Station 6 facility located at the new development at South Park Street and West Badger Road at an estimated cost of $700,000. Funding is available in Munis #17040. No additional appropriation is required.

Authorizing a noncompetitive contract with OPN Architects, Inc. to provide professional architecture and engineering services for Fire Station 06 at the proposed Community Development Authority’s South Park Street and West Badger Road Redevelopment Project (District 14).
Body
WHEREAS the 2024 Capital Budget includes funding for the proposed development including Fire Station 6 at South Park Street and West Badger Road; and,
WHEREAS in 2024 in accordance with MGO Section 4.26 of Madison General Ordinances and in accordance with Administrative Procedure Memorandum No. 3-3, “Retaining Architect, Professional Engineers, Designers and Land Surveyors for Consultant Service;” OPN Architects, Inc. was competitively selected as part of a larger development team through a request for proposal (RFP) process to provide professional architecture and engineering services toward a master planning effort for the CDA’s South Park Street and West Badger Road Redevelopment project that includes CDA housing, a Public Health Madison Dane County offices and clinic, and a new Fire Station 6; and,
WHEREAS, an evaluation team, administered by the Department of Planning and Community and Economic Development and the Community Development Authority and consisting of relevant Madison Engineering staff and Department of Planning and Community and Economic Development staff conducted a detailed evaluation, and scored and ranked each of the proposals using criteria including cost, skill, past performance, local vendor preference, and references; and the Alexander Company developer team including OPN Architects, Inc. was selected through this process; and,
WHEREAS OPN Architects, Inc.’s role on the development team was to provide design services related to the Fire Station 6 components of the redevelopment; and,
WHEREAS OPN Architects, Inc. and the larger development team has completed master planning and is moving into the next phases of design, construction documentation, bidding, construction administration, and warranty phases of the project; and,
WHEREAS the Engineering Division requires consulting services to complete the professional architecture and engineering design, construction, and warranty services for the project; and,
WHEREAS City staff recommend OPN Architects, Inc. continue to provide professional architect and engineering services for the design and construction administration phases for the proposed Fire Station 6 as the redevelopment proposal moves from master planning to site and building design and construction; and,
WHEREAS the core and shell of the Fire Station portion of the development will be constructed by the developer, the interior build-out of the Fire Station condominium space will be constructed via public works bidding and construction per state statutes; and,
WHEREAS the scope of the Fire Station 6 build-out project shall include professional architecture and engineering services that will achieve at a minimum LEED Certification-Silver per Madison Legislative File #07453 following the U.S. Green Building Council’s LEED for New Construction and Major Renovations (LEED-NC v.4) Rating System; and,
WHEREAS OPN Architects, Inc. has worked with the City previously providing all professional architecture and engineering design and construction services for Fire Station 14 at 3201 Dairy Dr, a LEED Platinum rated facility; and,
WHEREAS OPN Architects, Inc. has also worked with the City previously providing professional architecture and engineering services for the remodel and addition to the existing Fire Station 6 at 825 W Badger Rd. This project did not proceed to construction as the City of Madison opted to sell the site; and,
WHEREAS, under sec. 4.26(4)(b), of the Madison General Ordinances, if the aggregate amount of the fee for services will be $50,000 or more and the contract was not subject to a competitive bidding process, the contract shall meet one of the other requirements of sec. 4.26(4)(a) and be approved by the Common Council; and,
WHEREAS, for the reasons stated in the attached Noncompetitive Selection Request Form, the proposed contract with OPN Architects, Inc. meets the exception to the bidding process in section 4.26(4)(a)7. which states “A particular consultant has provided services to the City on a similar or continuing project in the recent past, and it would be economical to the City on the basis of time and money to retain the same consultant”; and,
WHEREAS, the contract with OPN Architects, Inc. is contingent on the approval of the developer agreements related to the proposed development at South Park Street and West Badger Road as approved by the Community Development Authority; and
NOW THEREFORE BE IT RESOLVED that the Mayor and City Clerk are authorized to execute a services contract not to exceed $700,000.00 with OPN Architects, Inc. for the above described services.
