Fiscal Note
The proposed resolution authorizes the Mayor and City Clerk to enter into a non-competitive contract for Purchase of Services with Continuum Architects + Planners for architectural and engineering services for the remodeling of the fourth and fifth floors of the City County Building (Phase 3/Level 4 and Phase 4/Level 5) in an amount not to exceed $823,073. Funding is available in the 2026 Adopted Engineering - Facilities Management Capital Budget in the CCB Office Remodels program (Munis #13667). No additional appropriation is required.

(District 4)
Body
WHEREAS, in November 2020, Continuum Architects + Planners was selected through a competitive “Request for Proposal” process (RFP # 8964-0-2020-BP), for Architectural/Engineering Design and Construction Administration technical services associated to Tenant Improvements on CCB’s First, Fourth, and Fifth Floor.
WHEREAS, Request for Proposals (RFP) No. 8964-0-2020-BP’s scope of work was structured into four (4) distinct phases intended for execution sequentially, and
WHEREAS, Authorization to proceed with RFP No. 8964-0-2020-BP Phase 1 and 2 was granted by Common Council through Enactment#: RES-21-00091, and
WHEREAS, RFP No. 8964-0-2020-BP Phase 1 and 2 was encumbered through Contract No. 8939 and is now substantially complete; and
WHEREAS, the remaining scope of work includes Phase 3 (Level 4) and Phase 4 (Level 5) architectural and engineering services for the remodeling of the fourth and fifth floors of the City County Building; and
WHEREAS, additional scope beyond what was originally considered in RFP # 8964-0-2020-BP is now required, including: Human Resources Offices design and construction, Engineering Public Service Counter design and construction, IT fiber infrastructure updates, and Updates to LEED requirements; and
WHEREAS, the parties propose a separate contract to address remaining Phases and additional services as an alternative to amending Contract No. 8939; and
WHEREAS, Continuum Architects + Planners has provided an updated Fee Proposal based on additional scope and escalation of Fee between 2020 to the current project schedule, totaling $823,073, and
WHEREAS, the proposed total of $823,073 represents a increase of $128,257 from the original proposed Phase 3 (Level 4) and Phase 4 (Level 5) which includes both cost escalation and additional design scope.
WHEREAS, under sec. 4.26(4)(b), of the Madison General Ordinances if the aggregate amount of the fee for services will be $50,000 or more and the contract was not subject to a competitive bidding process, the contract shall meet one of the other requirements of sec. 4.26(4)(a) and be approved by the Common Council; and
WHEREAS, for the reasons stated in the attached Noncompetitive Selection Request Form, the proposed contract with Continuum Architects + Planners meets the exception to the bidding process in section 4.26(4)(a)7. which states “A particular consultant has provided services to the City on a similar or continuing project in the recent past, and it would be economical to the City on the basis of time and money to retain the same consultant” and “Otherwise authorized by law, rule, resolution, or regulation”;
NOW, THEREFORE, BE IT RESOLVED that the Common Council hereby authorizes the Mayor and City Clerk to enter into a noncompetitive contract for Purchase of Services (Architect) with Continuum Architects + Planners for the amount not to exceed $823,073, in a form approved by the City Attorney, to complete Phase 3 and Phase 4 architectural and engineering design services for the remodeling of the first, fourth and fifth floors of the City County Building; and
BE IT FURTHER RESOLVED that this contract shall cover the remaining scope authorized under RFP # 8964-0-2020-BP, including the additional scope items identified above; and
BE IT FURTHER RESOLVED that the Common Council acknowledges that the original contract (Contract No. 8939) is substantially complete, and that this new contract is the mechanism through which remaining RFP # 8964-0-2020-BP-authorized work will be executed; and
BE IT FINALLY RESOLVED that the Designee of the Finance Director is authorized to execute amendments to the contract with Continuum Architects + Planners for extensions to the contract term.
