WHEREAS, in accordance with the Contract for Subdivision Improvements - Madison Commerce Park CSM - Contract No. 1877 the owners are required to dedicate, at no cost to the City of Madison, a 20-foot wide Public Storm Sewer Easement across the properties located at 4017 and 4035 Owl Creek Drive and 4018 Marsh Road; and
 
WHEREAS, the owners, The Lenhart Company, Inc., Mussehl, LLC, and Owl Creek Drive, L.L.C., have executed and delivered such Public Storm Sewer Easement to the City; and
 
WHEREAS, City of Madison Engineering Division staff have reviewed and recommend the acceptance of the easement.
 
NOW, THEREFORE, BE IT RESOLVED that the City of Madison is hereby authorized to accept from The Lenhart Company, Inc., Mussehl, LLC, and Owl Creek Drive, L.L.C, at no cost to the City of Madison, a 20-foot wide Public Storm Sewer Easement across the following described lands:
 
Part of Lots 4, 5 and 8, Madison Commerce Park, recorded in Volume 57-183B of Plats, on pages 765 and 766, as Document No. 3367639, Dane County Registry and part of Lots 1 and 2, Certified Survey Map No. 10462, recorded in Volume 62 of Certified Survey Maps on pages 1-4, Dane County Registry, all located in the NE ¼ of the SE ¼ of Section 27, T7N, R10E, City of Madison, Dane County, Wisconsin, to-wit:
 
Commencing at the northeast corner of said Lot 4; thence S01°37'33"E, 250.00 feet to the point of beginning; thence N88°22'27"E, 10.00 feet; thence S01°37'33"E, 60.00 feet; thence S88°22'26"W, 343.95 feet; thence N48°32'46"W, 49.14 feet; thence N41°27'14"E, 20.00 feet; thence S48°32'46"E, 41.25 feet; thence N88°22'26"E, 316.05 feet; thence N01°37'33"W, 40.00 feet; thence N88°22'27"E, 10.00 feet to the point of beginning.   Containing 8,503 square feet.
