Authorizing a Declaration of Change in Use from City park land to public street right-of-way for Willow Lane in the Highlands plat.
Body
WHEREAS, although Willow Lane is an existing street and appears on the original Town of Middleton Highlands plat as private, various subsequent recorded documents show Willow Lane without either a public or private designation; and
 
WHEREAS, the Highlands was annexed into the City of Madison in 1974; and
 
WHEREAS, the City of Madison Department of Public Works provides the plowing and maintenance for Willow Lane, and
 
WHEREAS, potential future development along Willow Lane would require that properties have frontage on a public street right-of way; and
 
WHEREAS, the City of Madison Engineering Division review interprets Willow Lane as a public street right-of-way; and
 
WHEREAS, the land in which Willow Lane is located is still designated as City of Madison park land; and
 
WHEREAS, the City of Madison Engineering Division recommends that a declaration of public right-of-way  be created and recorded for clarity now and in the future.
 
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Madison hereby authorizes the Mayor and City Clerk to execute a Declaration of Change of Use from City park land to City public street right-of-way for the following described landd:
 
Boundary Description of  Willow Lane:
Part of the unnumbered 'Park' parcel in Highlands plat (Doc. 312300),
which 'Park' adjoins Lots 11-13 Highlands, and adjoins CSM 4212, CSM 2011 and CSM 4721;
located in the NW1/4 of the SE1/4 and the SW1/4 of the SE1/4 of Section 13, T7N R8E,
City of Madison, Dane County, Wisconsin, described more particularly as follows:
 
Commencing at the southeast corner of Section 13, T7N R8E;
thence N89°47'20"W, 2634.91 feet to the south quarter-corner of said Section 13;
thence N38°08'52"E, 1496.74 feet to the west corner of Lot 2, Certified Survey Map
No. 4212,
on the easterly right-of-way of South Highlands Avenue;
thence S44°40'11"W, 0.47 feet along a jog in said right-of-way;
thence N57°28'42"W, 147.62 feet along said right-of-way to a tangent curve;
thence 78.90 feet along said right-of-way on a curve to the right, radius 652.09 feet,
