Authorizing the execution of a Permanent Limited Easement for highway and drainage purposes and Temporary Limited Easement for sloping and grading purposes to the State of Wisconsin Department of Transportation across City-owned land, located at 7074 Reston Heights Drive.
Body
WHEREAS, the State of Wisconsin Department of Transportation ("WisDOT") is proposing the reconstruction of existing IH94 from the Badger Interchange to County Highway N to expand the existing traffic lanes from four to six lanes due to increased traffic volumes; and
WHEREAS, the WisDOT reconstruction will also insure proper drainage in the area of a future IH94/Milwaukee Street bridge overpass at Milwaukee Street extended, located east of Sprecher Road within the Meadowlands Plat; and
WHEREAS, WisDOT has drafted a Transportation Project Plat No. 1066-02-21 ("TPP") which names the City of Madison as an owner and lists the real estate interests required for their project; and
WHEREAS, in order to accomplish the reconstruction project as designed, the WisDOT TPP requires a 0.26-acre Permanent Limited Easement for highway and drainage purposes, and a 455 square foot Temporary Limited Easement for sloping and grading purposes, from a City-owned parcel dedicated for stormwater management within the Second Addition to the Meadowlands Plat, located at 7074 Reston Heights Drive; and
WHEREAS, the City of Madison Engineering Division staff have reviewed and approve of the granting of such easements.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute an Permanent Limited Easement for Highway and Drainage Purposes and the Temporary Limited Easement for Sloping and Grading purposes ("Easements") to the State of Wisconsin Department of Transportation, on the following terms and conditions:
1. The Easement areas, are more particularly described below and depicted on attached Exhibit A
2. Any repair, maintenance or replacement of the highway structures and drainage facilities shall be the sole responsibility of WisDOT. Maintenance responsibilities shall include, but not be limited to, paving, repaving, repairing, and marking.
3. The City reserves the right to use and occupy the Easement areas in a manner consistent with the Easement, provided that such use and occupancy shall not interfere with or disturb WisDOT's use of the Easement areas. No buildings or structures of any kind shall be built over the Easement areas.
BE IT FURTHER RESOLVED that the City of Madison Office of Real Estate Services are authorized to execute waiver of appraisal and right-of-entry documents with the State of Wisconsin Department of Transportation to cooperatively convey necessary real estate interests for Transportation Project Plat 1066-02-21-4.03, if necessary.

A Permanent Limited Easement and Temporary Limited Easement identified as Parcel 10 of Transportation Project Plat 1066-02-21-4.03, being part of Outlot 15, Second Addition to the Meadowlands, Section 1, Town 7 North, Range 10 East, City of Madison, Dane County, Wisconsin.
