Approving Addendum No. 1 to Midpoint Meadows Phase 1 - Stormwater Management, Contract No. 9540 (District 1).

WHEREAS, on December 20, 2024, the developer, VH MIDPOINT MEADOWS, LLC, hereinafter the “Developer” had entered into a Contract For the Construction of Public Improvements that will be Accepted by the City of Madison hereinafter the “Contract” with the City of Madison, and;
WHEREAS, the Developer and the City have since mutually agreed to extend the agreement to include the stormwater associated improvements including installing and maintaining a riprap swale to manage stormwater runoff and erosion from the unfinished Raymond Road Right of Way.
WHEREAS, the Developer and the City have since mutually agreed that the Upper Wet Detention Pond included within Outlot 2 of the Midpoint Meadows Plat as shown in the Midpoint Meadows Phase 1 Stormwater Management Plan, sheet 1 of 3, Contract 9540, City Project No. 15406 shall remain under warranty until development adjacent to the site has stabilized and is no longer being used as a temporary sediment basin. Prior to final acceptance and expiration of the warranty the Developer shall submit as as-built of the Upper Wet Detention Pond to the City. The Developer shall be required to dredge the pond for any accumulated sediment, that decreases the storage depth below 7’. The Developer shall be responsible for all WDNR permits/approvals related to this work.
WHEREAS, the Developer and the City have since mutually agreed to add the requirement to purchase and install split rail boundary along the lands dedicated for public stormwater purposes per the specifications and details in the City of Madison Standard Detail Drawings (SDD).
NOW, THEREFORE, BE IT RESOLVE:
1. That the Mayor and City Clerk are hereby authorized and directed to execute Addendum No. 1 to Midpoint Meadows Phase 1 - Stormwater Management, Contract No. 9540, with VH MIDPOINT MEADOWS, LLC.
2. That the revised plans and specifications for the public improvements necessary to serve this project are hereby approved.
3. That the developer is authorized to construct the public improvements in accordance with the terms of the Contract For the Construction of Public Improvements That Will be Accepted by the City of Madison at the sole cost of the developer.
4. That the Mayor and City Clerk are hereby authorized to sign and grant easements or right-of-way release or procurement documents, maintenance agreements or encroachment agreements, as necessary and grant or accept dedication of lands and/or easements from/to the Developer/Owner for public improvements located outside of existing public fee title or easement right-of-ways.
5. The Common Council is approved to accept ownership of the improvements in the Maintenance Area if a maintenance agreement is executed and recorded as a condition of this contract.
