Fiscal Note
The proposed resolution authorizes acquisition cost for a permanent easement located at 3105 Woods Road for the purpose of extending the Ice Age Trail. The estimated acquisition cost for the permanent easement is $17,050. Funding for the acquisition is available in the Parks Division's 2026 Adopted Capital Budget (Munis #17128). No additional appropriation is required.

Authorizing the City’s acceptance of a Permanent Limited Easement for Public Pedestrian Trail Purposes from the Mary Ann McKenzie Legacy Trust over and across a portion of the property located at 3105 Woods Road in the Town of Verona, Wisconsin to extend the Ice Age National Scenic Trail.
Body
WHEREAS, the Mary Ann McKenzie Legacy Trust (“Trust”) is the owner of the property located at 3105 Woods Road in the Town of Verona (“Property”); and
WHEREAS, a portion of the Property is located within an Open Space Conservation Corridor, which includes a conceptual future route of the Ice Age Trail (“Trail”), as detailed in the 2009 Shady Wood Neighborhood Development Plan created by the City of Madison (“City”) Planning Division in the Department of Planning and Community and Economic Development; and
WHEREAS, in an effort to create future Trail connections from Moraine Woods Park to the Bitzer Preserve which are currently owned by the City of Madison, to existing Trail locations, the City must secure easements from area private property owners; and
WEREAS, the Property has been identified as one that could achieve the critical Trail connection, and the City negotiated the terms and conditions of a Permanent Limited Easement for Public Pedestrian Trail Purposes (“Easement”) with the Trust, which grants the City the right to access and construct a portion of the Trail over and across a portion of the Property.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and City Clerk are authorized to accept the Easement grant, with the signed Easement being attached for reference.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City’s Common Council hereby authorizes the Mayor and City Clerk to execute, deliver and record the Easement and take any further action required to accomplish the purpose of this resolution in a form approved by the City Attorney.
