Vacation/Discontinuance of part of the West Beltline Highway Frontage Road.
Body
WHEREAS, The portion of right-of-way to be vacated was originally acquired as public right-of-way by the Town of Madison by Document No. 1246859, Recorded July 30, 1969 in Volume 123 of Records, Page 413, Dane County Register of Deeds; and
WHEREAS, The Town of Madison will remove the existing cul-de-sac adjacent to the subject property and improve the frontage road, extending it westerly to connect with Ski Lane, as part of the "South Madison Project" of the Wisconsin Economic Development Authority, EDA # 06-01-04748, also referenced as Project No. AMADIT0302.00 of SEH, Inc.
WHEREAS, The right-of-way to be vacated is no longer necessary with the planned improvements described above;
BE IT RESOLVED, pursuant to Sec. 66.1003(4)(a), Wisconsin Statutes, the City of Madison declares it is in the public interest to vacate/discontinue:
A part of the Southerly Frontage Road of U.S. Highway 12 & 18 located in the Northeast 1/4 of the Southeast 1/4 of Section 35, Town 7 North, Range 9 East, City of Madison, Dane County, Wisconsin, to wit: Commencing at the East 1/4-corner of said Section 35; thence S00°01'20"E, 33.00 feet; thence S70°01'10"W, 751.79 feet; thence S00°9'20"W, 53.26 feet; thence thence S70°01'10"W, 197.13 feet to the Northeast corner of Lot 1, Certified Survey Map No. 5393, recorded in Volume 31 of Certified Survey Maps, on pages 321 and 322, Dane County Register of Deeds and the point of beginning; thence continuing S70°01'10"W along the Northerly line of Lot 1 and said Northerly line extended, 273.29 feet; thence N00°10'10"E, 53.26 feet; thence N70°01'10"E, 256.71 feet; thence S17°57'33"E, 50.03 feet to the point of beginning.  Parcel contains 13,250 square feet or 0.3042 acres.
BE IT FURTHER RESOLVED, the proposed area to be vacated is mapped in Exhibit A; and
BE IT FURTHER RESOLVED, under Section 80.32(4), Wisconsin Statutes, any existing public or private easement or incidental rights within the vacated rights-of-way are perpetuated unless specifically released as part of this vacation.
BE IT FURTHER RESOLVED, This resolution shall not be validated by recordation by the City Clerk until the encroaching business sign at 313 West Beltline Highway is relocated outside of the remaining public right-of-way, as negotiated by Genesis Development Corporation (owner of the property at 313 West Beltline Highway) and Badger Display Signs, Inc.
