The proposed resolution authorizes an agreement with the State of Wisconsin Department of Transportation for construction of the Capital City Path Extension from Wagon Trail to just east of I-39/90. The 2024 Adopted Capital Budget for Engineering - Bicycle & Pedestrian includes $1,890,000 for construction in 2027 (Munis #11158). Future capital budget requests will reflect the updated amounts per this proposed agreement. No additional appropriation is required.

PREAMBLE
The City of Madison Engineering Division is to construct a path from Wagon Trail to just east of Interstate-39/90, a critical segment for completing the extension from Madison to the Glacial Drumlin State Trail in Cottage Grove. This project includes an at-grade crossing of the railroad at Wagon Trail and a path under the Interstate using the existing railroad bridge underpass.
The project was awarded a federal grant under the Transportation Alternatives Program (TAP) that will reimburse 60% of participating construction costs to a maximum of $1,133,400. The proposed project is planned for construction in 2027. The City is responsible for 100% of the design and design review costs.
The agreement requires that the City indemnify the State of Wisconsin Department of Transportation. City APM 1-1 requires Common Council Approval whenever the City indemnifies another party.
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and City Clerk are hereby authorized to execute an agreement with the State of Wisconsin Department of Transportation for construction, construction oversight and cost sharing for the Capital City Path Extension project.
BE IT FURTHER RESOLVED, that the Common Council approves indemnification of the State of Wisconsin Department of Transportation as set forth in the agreement in order to use federal funds for the Capital City Path Extension project.
