Ordering Property Owners to Remove and Replace Unsafe, Defective and Insufficient Sidewalk in the 10th Aldermanic District (Wards 65,66,67 &68), and 20th Aldermanic District (Wards 84 & 85).

PREAMBLE
The City has adopted a plan to maintain sidewalk in all areas of the City over a 10 year period which started in 1996. The 10th Aldermanic District (Wards 65,66,67 &68), and 20th Aldermanic District (Wards 84 & 85) are scheduled for repair in 2005 and 2006.
Under this program unsafe, defective and insufficient sidewalk will be removed and replaced in accordance with the following “Criteria for Replacement of Public Sidewalk and Curb and Gutter” available at www.cityofmadison.com/engineering/sidewalk_repair.htm <http://www.cityofmadison.com/engineering/sidewalk_repair.htm> and listed as follows:
• sidewalk sections that contain offsets of ¾ inch or greater
• sidewalk sections that are smashed with radial cracks
• sidewalk that has diagonal cracks at the corner(s) of the section and cracks without aggregate interlock
• sidewalk with voids and erosion of the concrete, often at the joints
• sidewalk which is settled or tilted so that more than one-half of the width can pond water and ice
• sidewalk sections with excessive cross-slope
NOW THEREFOR BE IT RESOLVED, that the property owners of property in the 10th Aldermanic District (Wards 65,66,67 &68), and 20th Aldermanic District (Wards 84 & 85) are hereby ordered to remove and replace unsafe, defective and insufficient sidewalk in full compliance with the requirements of the City Ordinance governing such construction;
BE IT FURTHER RESOLVED, that the City Engineer shall serve Notice upon the owner or agent of each lot or parcel of land in front of which the work is ordered, and that a list of the property owners and parcels shall be maintained at office of the City Engineer.
BE IT FURTHER RESOLVED, that firm arrangements for such construction shall be made by the date specified on the Sidewalk Notice, and that if arrangements are not made by the aforesaid date, the City of Madison, will cause such sidewalk to be replaced and charge one-half of the cost thereof to the property in front of which the walk is laid, and such cost, unless previously paid, will be collected as a special tax against the property in front of which the walks are replaced.
