Approving temporary construction work with associated noise impacts between the hours of 7:00 PM and 7:00 AM for work associated with Madison Metropolitan Sewerage District West Interceptor - Shorewood Relief Phase 3 Project. (District 5)

Body

The Madison Metropolitan Sewerage District (MMSD) West Interceptor - Shorewood Relief Phase 3 project will install approximately 3,800 linear feet of sanitary sewer ranging from 30-inch to 48-inch diameter. Approximately half of the project (the “Shorewood Section”) is located completely in the Village of Shorewood Hills between Shorewood Boulevard and the University Station development east of Marshall Court.  The other half of the project (the “Highland Section”) is located in the City of Madison on the north side of Campus Drive in the on-ramp from Highland Avenue, through Highland Avenue, and in the off-ramp from Campus Drive to Highland Avenue. It is anticipated that in the Highland Section some weekend and evening construction may be required to meet traffic control requirements to minimize disruption to the UW and VA Hospitals and surrounding area. In addition both sections of the project will install Cured in Place Pipe (CIPP). The CIPP process does not allow for all construction activities of the project to take place during the normal working hours of 7:00AM and 7:00PM. Construction activities in the Shorewood Section will commence in approximately August 2024 and will take approximately 8 months to complete. Construction activities in the Highland Section will commence in approximately May 2025 and will take approximately 5 months to complete.

 

Madison General Ordinance section 24.08(3) provides the Common Council the ability to allow construction activities outside of the hours of 7:00 AM to 7:00 PM with the passage of a resolution and a hearing before the Board of Public Works. It is anticipated that the Contractor performing this work will call for permission to perform the work required to complete the project outside the hours of 7:00 AM to 7:00 PM because:

 

1.                     The CIPP process will exceed the twelve (12) hour window provided by the General Ordinance;

2.                     Work in the off ramp from Campus Drive, in Highland Avenue, and in the on ramp from Highland Avenue to Campus Drive will have major traffic control consequences so some of this work may occur during nights/weekends to minimize disruption of traffic to and from UW Health and VA hospitals and clinics;

3.                     Bypassing wastewater during components of the project will require the use of generators and pumps to be running beyond normal working hours continuously for 3 to 4 months.

 

The proposed activities beyond the hours of 7:00 AM to 7:00 PM may be as follows:

 

1.                     Cleaning of the sanitary sewer main sections to be lined via CIPP to remove any accumulated debris prior to lining;

2.                     Conducting a closed-circuit inspection of the sanitary sewer mains to be lined via CIPP to confirm that the line has been adequately cleaned prior to lining and to provide documentation to the district of pre-lining. conditions;

3.                     Installing the resin-impregnated felt liner into the sanitary sewer main;

4.                     Using steam, heated circulating water, or UV lights to cure the liner in place;

5.                     Conducting a closed-circuit inspection of the lined sections of sanitary sewer mains to provide documentation to the district that all required work has been satisfactorily performed.

6.                     Use of generators and pumps to bypass wastewater

7.                     Use of temporary piping to bypass wastewater;

8.                     Excavating to install the new pipe;

9.                     Installation of new pipe;

10.                     Installation of access structures;

11.                     Backfilling excavations;

12.                     Restoration activities such as paving and landscaping.

 

Activities that create impact noises, such as jack hammering, driving shoring, or delivery of materials in dump trucks with associated slamming of tailgates, are excluded from this resolution.

 

Items 1 - 5 are associated with the CIPP process.  Curing the CIPP will require working beyond normal hours for 1 night.  Items 6 & 7 will be required for the CIPP process and while the existing pipe is being removed and replaced in the Highland Section.  Items 6 & 7 will be required continuously for up to 15 weeks.  Items 8 - 12 may be desired to speed up completion of the Highland Section which will have major traffic impacts.  Work beyond normal working hours on items 8 - 12 will be limited to 20 occurrences during May - August of 2025 and shall be limited to the hours between 6:00 A.M. to 10:00 P.M. 

 

Construction activities generally exceed the noise limits imposed by the Madison General Ordinances and temporary construction activity between the hours of 7:00 AM to 7:00 PM is allowed to exceed the noise limits imposed by the Madison General Ordinances section 24.08 (3) provided the Common Council adopts a resolution allowing the construction.

 

NOW THEREFORE BE IT RESOLVED, that construction work, with associated noise impacts, between the hours of 7:00 PM and 7:00 AM on are hereby approved in accordance with Section 24.08(3) of the Madison General Ordinances., and

 

BE IT FURTHER RESOLVED, that the construction activities outside the hours of 7:00 AM and 7:00 PM are limited to those activities identified in this resolution, the hours specified, and the number of occurrences, and

 

BE IT FURTHER RESOLVED, that the Contractor shall provide a written request for work beyond normal hours to the Madison Metropolitan Sewerage District Project Engineer (the Project Engineer) at least 72 hours before such work is anticipated, and

 

BE IT FURTHER RESOLVED, that the Project Engineer may, at their discretion, provide written approval if the proposed work is reasonable and moves the project timeline forward to mitigate traffic impacts of the project, and

 

BE IT FURTHER RESOLVED, that if the Project Engineer allows the proposed after hours work then the Project Engineer shall provide at least 24 hour notice to the District 5 Alder and to the public, and

 

BE IT FURTHER RESOLVED, that the approval of that construction work, as provided in this resolution shall expire on September 30, 2025.
