DRAFTER'S ANALYSIS:  This ordinance makes some minor modifications in parking regulations, and allows metered parking in Residential Parking areas.    It amends Section 12.138 to allow mixed blocks of both Residential Parking and metered parking. Madison is encouraging developments that include both residential and commercial properties on the same block.  In order to respond to the growing needs of both residential and commercial parking, it is necessary to remove the language of the current ordinance which prohibits streets containing parking meters to be eligible for the Residential Parking designation.  Additionally, Section 12.138(5)(b) needs to be amended to include metered spots as an area that residential parking permit holders are not exempt from, in order to keep those spaces eligible for continuous parking turnover.  Section 12.138(8)(a) is being modified to remove the language of "attest" and replacing it with the language of "certify" to respond to the updated application process for the Residential Parking Permit Program.  This change makes it clear that applications need not be notarized.  Section 12.150 is being established to create areas of twenty-five minute metered parking and Section 12.145 is being modified to establish authority for Section 12.150 and establish rates therein. Finally, the ordinance also creates subsections in Sections 12.132 and 12.137 to include areas of Washington Avenue that are Parking Prohibited At All Times and Two Hour Parking 8:00 A.M. to 6:00 P.M., to conform the ordinances to actual postings

The Common Council of the City of Madison do hereby ordain as follows:
 
1.      Subsection (688) of Section 12.132 entitled "Parking Prohibited At All Times" of the Madison General Ordinances is created to read as follows:
 
"(688)      On the north side of Washington Avenue from Bedford Street to a point 140 feet east therefrom."
 
2.      Subsection (262) of Section 12.137 entitled "Two Hour Parking 8:00 A.M. To 6:00 P.M." of the Madison General Ordinances is created to read as follows:
 
"(262)      On both sides of Washington Avenue from Henry Street to Bassett Street and on the north side from Bassett Street to a point 250 feet east of Bedford Street and from Bedford Street to a point 350 feet west therefrom and on the south side from Bassett Street to a point 370 feet west of Bedford Street."
 
3.      Subdivision (a) of Subsection (4) entitled "Area and Street Designation and Eligibility" of Section 12.138 entitled "Residential Daytime Parking Privileges For "Commuter Parking Impacted" Streets" of the Madison General Ordinances is created to read as follows:
"(a)      At least one side or fifty percent (50%) of each block for which residential parking is requested must be zoned Residential (R1, R2, R3, R4, R4A, R4L, R5, R6, R6H). Streets having parking meters will not be eligible for designation."
 
4.       Subsection (8) entitled "Application" of Section 12.138 entitled "Residential Daytime Parking Privileges For "Commuter Parking Impacted" Streets" of the Madison General Ordinances is amended to read as follows:
 
"(8)      Application.
(a)      The application for a permit shall contain the name of the owner or operator of the motor vehicle, residential address, the motor vehicle's make, model, registration number, and the number of the applicant's operator's permit. The motor vehicle's registration and the operator's driver license shall be required to be presented to the Traffic Engineer or his/her designee at the time of making said application. In order to verify that the applicant legally resides at the address for which the permit is requested, the motor vehicle's registration and the operator's driver license shall show the address of the dwelling unit in the area for which the permit is sought. If the applicant for a residential parking permit is the owner of the vehicle sought to be registered and his/her permanent residence is at the address for which the permit is sought, then said vehicle shall be registered at the permanent address and shall have valid State of Wisconsin motor vehicle plates. If the applicant for a residential parking permit has his/her permanent residence at the address for which the permit is sought but the vehicle under his/her control indicates another address of residence for the owner of said vehicle, the applicant shall be required to attest certify that said vehicle is kept by the applicant and only at the address for which the permit is requested and that it will not be kept at any other location for the duration of the permit's validity. The applicant shall also provide an executed lease or other reasonable proof showing residence for the dwelling unit within the area for which the permit is sought. The permit shall be renewed annually upon such conditions and procedures as the Traffic Engineer shall specify.  The permit shall display the motor vehicle's license and expiration date.  
(b)      Certain temporary residents living in Madison may obtain a permit upon compliance with this subdivision, in addition to compliance with all other provisions of this section, except such motor vehicle shall be validly registered and licensed in the jurisdiction of lawful permanent residence of said applicant. Such temporary resident applicant shall attest under oath certify on the application for a permit that he or she: 1) maintains his/her permanent residence in another jurisdiction and shall specify the address thereof; 2) owns or operates a motor vehicle registered in the jurisdiction of permanent residence but which is housed at the Madison residence for which the permit is sought; 3) is living in Madison under a residential housing lease at a particular address and shall so specify with a complete address and telephone number, and name, address and telephone number of the rental agent or owner of the building in question; 4) that such statement is made for the purpose of obtaining a residential parking permit and that it is understood that any change in circumstances materially affecting any of the requirements of this ordinance or any false information or representation made in such statement shall be cause for immediate revocation of such permit. Further, such temporary resident applicant shall be required to provide a copy of his or her lease or other reasonable proof that such applicant is living at the address in question at the time of making such application."
 
5.       Subdivision (b) of Subsection (9) entitled "Parking Permits" of Section 12.138 entitled "Residential Daytime Parking Privileges For "Commuter Parking Impacted" Streets" of the Madison General Ordinances is amended to read as follows:
 
"(b)      A residential parking permit shall not authorize the holder thereof to stand or park a motor vehicle in such places or during such times as the stopping, standing, or parking of motor vehicles is prohibited, metered, or set aside to specified types of vehicles, nor exempt the holder from the observance of any traffic regulation other than the specified hourly parking limit. Residential parking permits do not exempt holders from Street Abandonment Regulations. Residential parking permits may be temporarily suspended by the City for snow removal, emergency or construction purposes."
 
6.      Subsection (1) entitled "Restrictions" of Section 12.145 entitled "Parking at Parking Meters and Meter Rates" of the Madison General Ordinances is amended to read as follows:
 
"(1)      Restrictions. In all parking meter zones established by Sections 12.1495, 12.1505, 12.150, 12.151, 12.1515, 12.1516, 12.1517 and 12.1518 or at any other on-street parking meter space established under the authority of the City Traffic Engineer and Parking Manager, no person shall park, stop or leave standing any vehicle, whether attended or unattended, unless the following provisions are strictly complied with:
(a)      The operator of every vehicle, upon stopping, standing or parking the vehicle at a parking meter space adjacent to which a parking meter is located, shall deposit in such parking meter the proper payment as required by the directions on the meter and remove the vehicle therefrom prior to the expiration of the time limit indicated on the meter.
(b)      No such vehicle shall be parked, stopped or left standing for a longer period than the applicable time limit specified in Section 12.1495,12.1505, 12.150,12.151, 12.1515, 12.1516, 12.1517, or 12.1518.
(c)      The operator of such vehicle shall comply with all other provisions of this chapter relating to the parking, stopping or leaving a vehicle standing, except those provisions which by their very nature would have no application.
      (d)      No person shall stop, park or leave standing any vehicle at a parking space adjacent to a parking meter for the purpose of conducting street vending directly from the vehicle, during the hours in which that meter is enforced.  "Street vending" shall have the meaning established in Section 9.13.  This prohibition shall apply to all on-street parking meter zones established by this Chapter, during the hours of enforcement established herein."
 
7.      Subdivision (a) of Subsection (3) entitled "Rates" of Section 12.145 entitled "Parking at Parking Meters and Meter Rates" of the Madison General Ordinances is amended to read as follows:
 
"(a)      Parking meter zones established by Sections 12.1495, 12.1505, 12.150,12.1515, 12.1516, 12.1517 and 12.1518:  fifty cents (50ยข) per hour for the ten-hour meters, and one dollar and twenty-five cents ($1.25) per hour for all other meters."
 
8.      Section 12.150 entitled "Twenty-Five Minute Parking Meter Zones" of the Madison General
Ordinances is created to read as follows:
 
"12.150      TWENTY-FIVE MINUTE PARKING METER ZONES.
The following streets and parts of streets are declared to be twenty-five (25) minute parking zones, and no person shall park, stop or leave standing any vehicle in any parking space within such zones in excess of twenty-five (25) minutes, except in compliance with the provisions of Section 12.145.
(1)      On the north side of Washington Avenue from a point 140 feet east of Bedford Street to a point 100 feet east therefrom."
