Approving temporary construction work with associated noise impacts between the hours of 7:00 PM and 7:00 AM on East Johnson Street from North Butler Street to North Baldwin Street.  (2nd AD)
Body
The City of Madison has proposed a project to reconstruct East Johnson Street from N Butler Street to N Baldwin Street in 2014.  The proposed project includes the replacement of sanitary sewer, storm sewer, water main, street lights, traffic signals, curb & gutter and asphalt pavement.  Due to the volume of traffic on East Johnson Street, and the expedited work schedule, we propose to allow Contractors to work between the hours of 7:00 PM to 7:00 AM.  Work between the hours of 7:00 PM to 7:00 AM will be allowed only on a limited basis when deemed necessary, and must be preapproved by the City Engineer.
 
Madison General Ordinance section 24.08(3) provides the Common Council the ability to allow construction activities outside of the hours of 7:00 AM to 7:00 PM with the passage of a resolution and a hearing before the Board of Public Works.   
 
The work associated with the project cannot be fully constructed between the hours of 7:00 AM and 7:00 PM because:
 
1.      The amount of construction needed to complete the project exceeds the amount of production that a Contractor can reasonably be expected to achieve between the hours of 7:00 AM and 7:00 PM, even with the extra crews.
 
2.      Private utility companies will be installing infrastructure in conjunction with the project that will require the closure of all travel lanes on East Johnson Street, at limited times, to allow the placement of large concrete utility vaults.  When necessary, the closure of all travel lanes will be allowed for short periods of time and will take place during night time, off peak travel hours to limit the impact and delay to the traveling public.
 
 
The proposed activities beyond the hours of 7:00 AM to 7:00 PM are as follows:
 
1)  General construction activities between the hours of 7:00 PM and 9:00 PM.  The intent is to provide Contractors with the ability to work two additional hours in the evening for general construction activities when deemed necessary.  Contractors will only be allowed to work between the hours of 7:00 PM and 9:00 PM if the proposed work is preapproved by the City Engineer.  The expectation is that work during night time hours will occur infrequently during the project.  In addition to the General Contractor and subcontractors, this provision shall apply to utilities and their Contractors doing coordinated work during the project construction.
 
2)  Certain utility construction activities and placement of concrete utility vaults will require limiting travel lanes on East Johnson Street and will be specified to be completed during off-peak traffic hours, between the hours of 7:00 PM and 7:00 AM.  Allowing work during off-peak, night-time hours will give the Contractor necessary time to complete these operations without affecting peak hours of traffic.  It is expected that this work will occur approximately four times during the project.
 
3)  Private utility companies will be required to adjust their facilities to accommodate the reconstruction project and will be installing new facilities in conjunction with the project.  In order to facilitate the completion of this work in a timely fashion, private utilities will be allowed to engage in general construction activities between the hours of 7:00 PM and 7:00 AM.  General construction actives include splicing operations, operation of portable generators and portable equipment as necessary to perform the work on private utility owned lines, poles and in underground structures.
 
The Contractor and private utility companies shall make every effort to limit this construction to the hours of 7:00 AM to 7:00 PM but shall be allowed to work beyond those hours at limited times if determined to be necessary by the City Engineer or designee.  All work taking place between the hours of 7:00 PM and 7:00 AM shall be preapproved by the City Engineer.  Excessively loud construction operations, such as pile driving, sheeting driving or concrete breaking will not be allowed between the hours of 9:00 PM and 7:00 AM.
The limits of construction are East Johnson Street from N Butler Street to N Baldwin Street.  
 
NOW THEREFORE BE IT RESOLVED, that construction work, with associated noise impacts, between the hours of 7:00 PM and 7:00 AM on East Johnson Street from North Butler Street to North Baldwin Street are hereby approved in accordance with section 24.08(3) of the Madison General Ordinances, and
 
BE IT FURTHER RESOLVED, that the construction activities outside of the hours of 7:00 AM to 7:00 PM are limited to those activities identified in this resolution and are limited to the hours specified, and
 
BE IT FURTHER RESOLVED, that the approval of that construction work, as provided in this resolution shall expire on December 31, 2014.
