SUBSTITUTE - Amending Chapter 3 of the Madison General Ordinances by repealing those sections that regulate boards, committees and commissions and recreating them in Chapter 33, repealing other miscellaneous sections to relocate them in the appropriate chapters, and amending necessary sections throughout the ordinances to update references to the renumbered sections.

DRAFTER'S ANALYSIS: This is one of two companion ordinances that accomplish a reorganization of Chapter 3 of the Madison General Ordinances. This ordinance moves a number of provisions of Chapter 3, relating to City Boards, Commissions, and Committees, into Chapter 33, which is renamed "Boards, Commissions, and Committees". The companion ordinance (ID #05744 ) renumbers much of Chapter 3 and divides it into 5 subchapters.
As part of this reorganization, a number of ordinances related to Civil Rights are moved to a separate Chapter 39, entitled "Department of Civil Rights",
Except for the repeal of outdated sections, neither of these ordinances is intended to make substantive changes in Chapter 3. Once the reorganization has been accomplished through passage of these ordinances, the task of updating Chapters 3, 33, and 39 for substantive changes will be undertaken.

The Common Council of the City of Madison do hereby ordain as follows:
1. Section 3.045 entitled "Chairperson Restriction" of the Madison General Ordinances is renumbered and relocated to Subsection (2) of new Section 33.01.
2. Section 3.05 entitled "Board of Police and Fire Commissioners" is renumbered and relocated to Section 33.06.
3. Section 3.07 entitled "Board of Park Commissioners" of the Madison General Ordinances is renumbered and relocated to Section 33.05.
4. Section 3.08 entitled "Board of Review" of the Madison General Ordinances is renumbered and relocated to Section 33.08.
5. Section 3.09 entitled "Commission on The Environment" of the Madison General Ordinances is renumbered and relocated to Section 33.11.
6. Section 3.10 entitled "Board of Public Works" of the Madison General Ordinances is renumbered and relocated to Section 33.07.
7. Section 3.17 entitled "Purchasing Division" of the Madison General Ordinances is renumbered and relocated to Section 4.27.
8. Section 3.18(Introduction), (1), and (2) entitled "Office of Community Services" of the Madison General Ordinances is hereby repealed.
9. Section 3.18(3) entitled "Child Care Program" of the Madison General Ordinances is renumbered as Section 3.12(9) and relocated to Subchapter 3A entitled "Organization, Offices and Departments" of Chapter 3 entitled "Government Organization, Officials and Employees" of the Madison General Ordinances.
10. Section 3.185 entitled "Community Services Commission" of the Madison General Ordinances is renumbered and relocated to Section 33.16.
11. Section 3.19 entitled "Monona Terrace Convention and Community Center Board" of the Madison General Ordinances is renumbered and relocated to Section 33.21.
12. Section 3.20 entitled "Board of Assessors" of the Madison General Ordinances is renumbered and relocated to Section 33.03.
13. Section 3.23 entitled "Equal Opportunities Ordinance" of the Madison General Ordinances is renumbered and relocated to Section 39.03.
14. Section 3.26 entitled "City-County Commissions" of the Madison General Ordinances is renumbered and relocated to Section 33.09.
15. Section 3.39 entitled "Board of Canvassers" of the Madison General Ordinances is renumbered and relocated to Section 33.04.
16. Section 3.40 entitled "City Employees Merit Award Commission" of the Madison General Ordinances is renumbered and relocated to Section 33.10.
17. Section 3.43 entitled "Prohibitions Against Professional Strikebreakers" of the Madison General Ordinances is renumbered and relocated to Section 23.37.
18. Section 3.46 entitled "Obsolete Committees and Commissions" of the Madison General Ordinances s renumbered and relocated to Section 33.26.
19. Section 3.54 entitled "Economic Development Commission" of the Madison General Ordinances is renumbered and relocated to Section 33.17.
20. Section 3.55 entitled "Common Council Organizational Committee" of the Madison General Ordinances is renumbered and relocated to Section 33.13.
21. Section 3.56 entitled "Alcohol License Review Committee" of the Madison General Ordinances is renumbered and relocated to Section 33.02.
22. Section 3.58 entitled "Affirmative Action Ordinance" of the Madison General Ordinances is renumbered and relocated to Section 39.02.
23. Section 3.60 entitled "Reverend Doctor Martin Luther King, Jr. Humanitarian Award" of the Madison General Ordinances is renumbered and relocated to Section 39.06.
24. Section 3.62 entitled "Commission on People with Disabilities" of the Madison General Ordinances is renumbered and relocated to Section 39.04.
25. Section 3.65 entitled "Public Safety Review Board" of the Madison General Ordinances is renumbered and relocated to Section 33.22.
26. Section 3.67 entitled "Committee on Community Gardens" of the Madison General Ordinances is renumbered and relocated to Section 33.12.
27. Section 3.68 entitled "Joint City-County Section 8 Rental Housing Provider Advisory Commission" of the Madison General Ordinances is renumbered and relocated to Section 33.18.
28. Section 3.70 entitled "Community Development Block Grant (CDBG) Commission" of the Madison General Ordinances is renumbered and relocated to Section 33.15.
29. Section 3.71 entitled "Madison Cultural Arts District Board" of the Madison General Ordinances is renumbered and relocated to Section 33.20.
30. 3.72 entitled "Nondiscrimination Based on Disability in City Facilities and City-Assisted Programs and Activities" of the Madison General Ordinances is renumbered and relocated to Section 39.05.
31. Section 3.73 entitled "Solid Waste Advisory Committee" of the Madison General Ordinances is renumbered and relocated to Section 33.23.
32. Section 3.79 entitled "Report of Vacancies" of the Madison General Ordinances is renumbered and relocated to Section 33.26.
33. Chapter 33 entitled "Commissions" of the Madison General Ordinances is amended by amending the title as follows:
"BOARDS, COMMISSIONS, AND COMMITTEES."
34. Subsection (1) of New Section 33.01 of the Madison General Ordinances is created to read as follows:
"(1) Purpose and Intent. The purpose of Chapter 33 is to compile in one location the ordinances establishing and regulating City boards, commissions, and committees. In some cases, however, it has been deemed advantageous to maintain these regulations with the ordinance related to the subject matter of the board, commission, or committee. Furthermore, those boards, commissions, and committees that are created by resolution of the Common Council are not included in the Madison General Ordinances."
35. Current Section 33.01 entitled "Landmarks Commission" of the Madison General Ordinances is renumbered and relocated to Section 33.19.
36. Section 33.02 entitled "Urban Design Commission" of the Madison General Ordinances is renumbered and relocated to Section 33.24.
37. All other necessary sections throughout the Madison General Ordinances are amended to update references to the renumbered sections.
