Fiscal Note

The proposed resolution authorizes the City to enter into an Assistance Agreement with the Wisconsin Division of Emergency Management (WEM) to accept program assistance from a Federal Emergency Management Agency (FEMA) Building Resilient Infrastructure and Communities (BRIC) grant. Under the program, FEMA will provide 70% of the funding for the BRIC grant, totaling $6,028,190 and the City is responsible for 30% of matching funds, totaling $2,583,510. Funding is included in the 2024 Stormwater Utility Executive Capital Budget in the Citywide Flood Mitigation Program (Munis #11513). No additional appropriation is required.

Authorizing the City of Madison to accept a grant and enter an Assistance Agreement with the Wisconsin Division of Emergency Management (WEM) to receive Building Resilient Infrastructure and Communities (BRIC) program assistance from the Federal Emergency Management Agency (FEMA). 

Body

The City of Madison Engineering Division is reconstructing the stormwater ponds and greenways in the Old Sauk Trails Business Park on the far west side of the City (the “Project”). The reconstructed ponds and greenways will help the City meet its Wisconsin Pollutant Discharge Elimination System (WPDES) Municipal Separate Storm Sewer System (MS4) permit goals and meet our flood reduction targets.

On January 19, 2021, by RES-21-00051 (Legistar File # 63511), the Council authorized the City to apply for grant assistance for the Project under the Federal Emergency Management Agency (FEMA) Building Resilient Infrastructure and Communities (BRIC) program, which grant is administered by the Wisconsin Division of Emergency Management (WEM).  The City has received notification that it was awarded the FEMA BRIC grant to partially fund the Project. The FEMA BRIC grant includes a 30 percent cost share of non-federal funds. The $2,583,510.00 cost share for the City was part of the 2023 Adopted Stormwater Utility Capital Improvement Plan for fiscal year 2024, and is included in the 2024 Stormwater Utility Executive Capital Budget.

 

NOW, THEREFORE, BE IT RESOLVED THAT the City accepts the FEMA BRIC grant and the Mayor and City Clerk are authorized to enter into the State-Local Hazard Mitigation Assistance Agreement for the Stormwater Flood Mitigation Project in the Old Sauk Trails Business Park with WEM, in a format approved by the City Attorney, in order to receive the FEMA BRIC grant funds for the Project. 

 

BE IT FURTHER RESOLVED that the City of Madison Stormwater Utility will meet the financial obligations necessary to fully and satisfactorily complete the project and satisfy the City’s required share of the Project costs.

 

BE IT FINALLY RESOLVED that the City Engineer is authorized to submit required documentation and execute documents on behalf of the City as required by the grant and the Agreement, subject to approval as to form by the City Attorney where appropriate.
