Amending Section 9.13(6)(j)1.a. of the Madison General Ordinances to allow all Mall/Concourse merchant vendors to display sidewalk merchandise on the same days.

DRAFTER'S ANALYSIS: This ordinance would allow all licensed merchant vendors on the State Street Mall / Capitol Concourse to display merchandise for sale on sidewalks on the same days: Thursdays, Fridays, Saturdays, and Sundays. (Under the current ordinance, King Street merchants cannot put out merchandise on Sundays.)

The Common Council of the City of Madison do hereby ordain as follows:
Subparagraph a. of Paragraph 1. entitled "Miscellaneous Restrictions on Merchant Vendors" of Subdivision (j) entitled "Miscellaneous Restrictions on Merchant Vendors and Sidewalk Cafes" of Subsection (6) entitled "Regulations and Procedures for Vending on the State Street Mall/Capitol Concourse" of Section 9.13 entitled "License For Selling On Public Streets" of the Madison General Ordinances is amended to read as follows:
"a. Merchandise may only be displayed during normal business hours on Thursdays, Fridays, Saturdays, Sundays and the following federal public holidays established under 5 U.S.C. § 6103 (New Year's Day, Washington's Birthday, Martin Luther King Jr.'s Birthday, Memorial Day, Independence, Labor Day, Columbus Day, Veteran's Day, Thanksgiving Day, Christmas Day). with the following exceptions: merchant vendors on portions of King Street within the Mall/Concourse may display merchandise only on Thursdays, Fridays and Saturdays; and all Mall/Concourse merchant vendors may display merchandise on other days, if approved by the Vending Oversight Committee (VOC) in conjunction with a special event for which a street use permit has been granted, upon the VOC's determination that such merchant vending will not interfere with the events and will enhance the public use and enjoyment of the Mall/Concourse."
