Fiscal Note
In the adopted 2016 Capital Budget the Parks Division has budgeted $1,500,000 for the park improvements at Penn Park, under the Parks Penn Park Project (MUNIS 17178). This program has sufficient funding for the proposed work in this resolution. Funding is provided by GO borrowing.
The proposed resolution approves an agreement for architectural and design services for the Penn Park restroom project at an estimated cost of $29,890.

Title
Authorizing the Mayor and the City Clerk to enter into an agreement with Destree Design Architects Inc, in the amount of $29,890 for additional architectural and engineering design services to complete the construction documents for a Park Restroom Prototype Building and the Penn Park Restroom.
Body
Whereas, the parties, the City of Madison ("City") and Destree Design Architects Inc ("Architect" or "Contractor") have completed a contract for purchase of architectural and engineering design services for Schematic Design of a Park Restroom Prototype Building in 2014, and,
Whereas, this contract is the continuing development and preparation of architectural and engineering design, Design Development, Construction Drawings and Specifications to complete the Park Restroom Prototype Building; and preparation of bid documents, assistance in the bid process and construction administration services for the construction of a new Penn Park Restroom Building at 2101 Fisher Street and,
Whereas, additional professional design services shall include civil, architectural, structural, HVAC, plumbing, electrical engineering, and other disciplines as required, and,
Whereas, the project will expedite the implementation of the Park Restroom Prototype Building to replace an existing undersized and out-dated restroom building, and,
Whereas, Destree Design Architects is a local firm with expertise on park restroom buildings and public process, and has completed the Schematic Design process with the Parks Department, has presented to Urban Design and has held neighborhood meetings, and,
Whereas, under MGO 4.26(4)(b), if a service contract exceeds $25,000 and the contract was not subject to a competitive selection process, the contract shall meet one of the requirements of sec. 4.26(4)(a) and be approved by the Common Council, and signed by the Mayor and Clerk; and
Whereas, Destree Design Architects Inc located at 222 W Washington Ave, Madison WI has been selected as the sole source to continue and complete the design process to expedite the project, which is allowed under MGO Section 4.26(4)(a)7 Madison General Ordinances, which provides that a contract may be approved without a competitive selection process if the contractor has performed similar services in the past and it would be economical on the basis of time and money to retain the same firm and,
Whereas, the 2016 Capital Budget includes funding in Acct. No.17137-51-200 for architectural and engineering consultant design services, an Architect consultant must be hired to design these additional services, and,
Now, Therefore, BE IT RESOLVED that the Common Council hereby authorizes the Mayor and the City Clerk to enter into a contract for purchase of services between the City of Madison and Destree Design Architects Inc to authorize the additional work as described above and payment in the amount not to exceed $29,890.00.
