Approving plans and specifications for public improvements in addition to private landscaping and parking plan and authorizing the release of a platted building setback line and landscape buffer necessary for the project known as Old Sauk Trails Box Culvert Extension and authorizing construction to be undertaken by the Developer, Private Contract No. 2207. (9th AD)
Body
WHEREAS, the final plat of Old Sauk Trails Park was approved and recorded with a 100-foot wide building setback line, stormwater drainage easement and landscape buffer parallel to the westerly right of way line of the Beltline Highway (USH 12 & 14); and
 
WHEREAS, the developer, Old Sauk Trails Limited Partnership, is requesting the City of Madison's approval to expand the existing parking lots and subsequent storm box culvert extension into said 100-foot wide platted building setback line, stormwater drainage easement and landscape buffer for the properties located at 8010 - 8040 Excelsior Drive; and
 
WHEREAS, Section 16.23(9) of the Madison General Ordinances and the conditions of approval require the developer to install the public improvements necessary to serve the development; and
 
WHEREAS, it is necessary for the City to consent to the expansion of the existing parking lots in the 100-foot wide platted stormwater drainage easement; and
 
WHEREAS, it is necessary for the City and WIDOT to release a portion of the existing 100-foot wide platted building setback line and landscape buffer in order to accommodate the expanded parking lots.
 
NOW, THEREFORE, BE IT RESOLVED:
 
1.      That the Mayor and City Clerk are hereby authorized and directed to execute a Contract For the Construction of Public Improvements that will be accepted by the City of Madison for Old Sauk Trails Box Culvert Extension, with Old Sauk Trails Limited Partnership.
 
2.      That the plans and specifications for the public improvements necessary to serve the development are hereby approved.
 
3.      That the developer is authorized to construct the public improvements in accordance with the terms of the Contract For the Construction of Public Improvements that will be accepted by the City of Madison at the sole cost of the developer, except as follows: NONE
 
4.      That the contract for public improvements shall include the City's consent to the expansion of the existing parking lots into the 100-foot wide platted stormwater drainage easement, subject to the City's prior rights and interest in said easement.
5.      That the Mayor and City Clerk are hereby authorized to release the westerly 58 feet of the 100-foot wide platted building setback line and landscape buffer and to sign such other easements or right-of-way release or procurement documents, maintenance agreements or encroachment agreements as may be necessary and to accept dedication of lands and/or easements from the Developer/Owner for public improvements located outside of existing public fee title or easement right-of-ways.
 
6.      That the developer is required to install and maintain a landscaped buffer as part of the construction of the expanded parking lots according to a plan approved by the Director of the Department of Planning and Community and Economic Development or his designee.
 
7.      That the City's consent to the expansion of the existing parking lots into the 100-foot wide stormwater drainage easement and the City's release of a portion of the existing 100-foot wide building setback line and landscape buffer shall be contingent upon the developer obtaining the necessary authorization from WIDOT to expand the existing parking lots into the 100-foot wide highway setback area.
 
8.      That the platted 100-foot wide stormwater drainage easement shall not be affected by the City's easement release and shall remain in full force and effect.
 
9.      That the platted10-foot wide utility easement, the easterly line of which is coterminous with the westerly line of the platted 100-foot wide stormwater drainage easement shall not be affected by the City's easement release and shall remain in full force and effect.
Fiscal Note
Private Contract, No City Funds Required. Owner/Applicant shall pay the $500 Real Estate Administrative Fee associated with Real Estate Project No. 8988.
